A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AMENDING RESOLUTION NO. 79-16115,
PROVIDING FOR THE TERMINATION OF THE SEWAGE COLLECTION
AND DISPOSAL SYSTEM CONTRACT BETWEEN THE CITY OF MIAMI
BEACH AND THE TOWN OF NORTH BAY VILLAGE, TO RECITE THAT
THE PERFORMANCE OF THE TERMS OF THIS CONTRACT BY THE
CITY OF MIAMI BEACH IS RENDERED IMPOSSIBLE BY THE
ACTIONS OF THE STATE OF FLORIDA AND METROPOLITAN DADE
COUNTY.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1: That Resolution No. 79-16115 be and the same is hereby
amended by adding thereto new sections to be designated
as Sections 4 and 5 respectively, which shall immediately follow
Section 3 and shall read as follows:
SECTION 4 : The said contract is terminated
pursuant to Paragraph 10 thereof
since the United States of America and the
State of Florida have mandated that the City
cease using its ocean outfall system of sewage
disposal, which was in use at the time of
execution of the contract, and connect its
sewage collection system to a regional treat-
ment plant, which connection, it is expected,
will be completed in the near future.
SECTION 5: The City Manager is hereby authorized
to cause the services rendered under
said contract to continue to be provided at the
same rates as set in said contract until such
time as the City begins pumping its sewage to
the Miami-Dade Water and Sewer Authority treat-
ment plant.
SECTION 2 : That the City Clerk be and she is hereby authorized and
directed to cause a copy of this resolution to be
delivered to the Mayor and the City Manager of the Town of North
Bay Village.
