2003-25248 ResoRESOLUTION NO. 2003-25248 A RESOLUTION OF THE MAYOR AND CITY COMM,ISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING ON JULY 30, 2003, TO HEAR PUBLIC COMMENT REGARDING A LEASE AGREEMENT WITH THE MIAMI BEACH FEDERAL CREDIT UNION, FOR THE LEASE OF APPROXIMATELY 1350 SQUARE FEET OF CITY- OWNED PROPERTY LOCATED AT 1701 MERIDIAN AVENUE, MIAMI BEACH, FLORIDA; FURTHER TO CONSIDER WAIVER, BY 5/7THS VOTE, OF THE COMPETITIVE BIDDING AND APPRAISAL REQUIREMENTS; AS REQUIRED BY SECTION 82-39 OF THE MIAMI BEACH CITY CODE. WHEREAS, the City of Miami Beach (City) and the Miami Beach Federal Credit Union (Credit Union) have agreed to enter into a one (1) year lease, with any renewal option(s) being at the City's sole discretion, for the use of approximately 1350 square feet of City-owned property located at 1701 Meridian Avenue (the Property) as a federal credit union; and WHEREAS, Section 82-39 of the Miami Beach City Code, goveming the sale/lease of public property, requires a public bidding process, a Planning Department analysis, and an independent appraisal to determine the value of the leasehold interest; as well as a public hearing to obtain citizen input; and WHEREAS, Section 82-39 further provides for the waiver of the competitive bidding and appraisal requirements, by 5/Tths vote of the Mayor and City Commission, for leases of City land, upon a finding by the Mayor and City Commission that the public interest would be served by waiving such conditions. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission of the City of Miami Beach, Florida, set a public hearing on July 30, 2003, to hear public comment regarding a Lease Agreement for the lease of approximately 1350 square feet of the City-owned property located at 1701 Meridian Avenue, Miami Beach, Florida; further to consider waiver, by 5/7ths vote, of the competitive bidding and appraisal requirements, as required by Section 82-39 of the Miami Beach City Code. From: Subject: ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS For more than a decade, the Miami Beach Federal Credit Union (Credit Union) has been occupying approximately 1635 square feet of space in the 555 17th Street building. As part of the City's office relocation plan, it was deemed in the City's best interest to relocate the Credit Union to the vacant retail ground floor space in the recently acquired 1701 Meridian Avenue (a.k.a. 777 17th Street) building. The City Commission authorized the purchase of the 1701 Meridian Avenue building, in part, to address the City's ongoing need for administrative office e.x~pansion space on a graduated basis. Furthermore, the building located at 555 17 TM Street, and more specifically, the space currently occupied by the Credit Union, will be renovated in order to house the City's Human Resource Department. The City and the Credit Union have agreed to enter into a one (1) year lease, with any renewal option(s) being at the City's sole discretion, for the use of approximately 1350 square feet of City-owned property located at 1701 Meridian Avenue as a federal credit union. Historically, the Credit Union has not paid the City any rent and/or operating expenses. When relocation to the 1701 Meridian Avenue building was discussed with the Credit Union, they advised that their budget would not support any lease payments, however, under the proposed Lease Agreement, the Credit Union has agreed to pay the City its proportionate share of operating expenses, insurance, and if applicable, real estate taxes. While the Administration has begun addressing the City's aforestated administrative office expansion need at both buildings, the Administration also considers that the preservation of a retail environment on the ground floor of the 1701 Meridian Avenue property, at this time, is conducive to maintaining the pedestrian character of the linkage between Lincoln Road Mall and the Civic/Convention Center area. The Administration deems the proposed move of the Credit Union to this new location is deemed to be in the City's best interest. Furthermore, since the Credit Union's operation is viewed as an amenity and benefit to the City and its employees, it is recommended and deemed in the City's best interest to waive the competitive bidding and appraisal requirements. Section 82-39 of the Miami Beach City Code, governing the sale/lease of public property, provides that the lease of any City-owned property, including option periods, requires the following: 1) 2) 3) 4) a public bidding process a Planning Department analysis an independent appraisal to determine the value of the leasehold interest a public hearing to obtain citizen input Section 82-39 further provides for the waiver of the competitive bidding and appraisal requirements, by 5/Tths vote of the Mayor and City Commission, upon a finding by the Mayor and City Commission that the public interest would be served by waiving such conditions. There is also a requirement that there be a minimum fifteen (15) day advertised notice advising of the public hearing. In order to enable the Mayor and City Commission to hold the public hearing in a timely manner, the Administration is recommending that the date for said public hearing be set at this time. Based on the foregoing, the Administration recommends that the Mayor and City Commission set the public hearing for July 30, 2003, to consider the proposed Lease and proposed waiver of the competitive bidding and appraisal requirements.
