2003-25253 Reso RESOLUTION NO. 2003-25253 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AUTHORIZING THE MAYOR AND CITY COMMISSION TO GRANT THE ATTACHED NON-EXCLUSIVE EASEMENT TO FLORIDA POWER & LIGHT COMPANY (FP&L) FOR THE PROVISION OF UNDERGROUND DISTRIBUTION FACILITIES AND A TRANSFORMER PAD AT THE NORMANDY ISLE PARK AND POOL FACILITY; AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND RECORD THE EASEMENT FOR THE REQUIRED UNDERGROUND FACILITIES AND TRANSFORMER PAD. WHEREAS, the City owns the Normandy Isle Park and Pool Faclities (Property); and WHEREAS, as part of the City's Parks and Recreation General Obligation Bond Parks Master Plan, the City initiated the improvements to the Normandy Isle Park and Pool Facilities; and WHEREAS, on March 16,2001, the City issued RFP No. 21-00/01 for the construction of the Normandy Isle Park and Pool Facility; and WHEREAS, on March 20, 2002, following evaluations by a Selection Committee and negotiations with the contractors, the City passed and adopted Resolution No. 2002-24800 awarding Regosa Engineering, Inc. the construction contract for the Normandy Isle Park and Pool Facility; and WHEREAS, construction on the project started in June 2002 and has been proceeding on schedule with an anticipated substantial completion date of October 30,2003; and WHEREAS, in order to supply the electrical power to the Property, Florida Power and Light (FP&L) has to install a transformer on a pad with underground feeders at the Property; and WHEREAS, to energize the system, FP&L is requesting the City to grant the attached easement for the pad mount transformer and the underground transmission ducts area. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approve the grant of the attached Non-Exclusive Easement to Florida Power & Light Company (FP&L) for a transformer pad and associated ducts to the Normandy Isle Park and Pool Facility and authorize the Mayor and City Clerk to execute and record the Easement for the required underground facilities and transformer pad. ADMINISTRATION RECOMMENDATION: Adopt the Resolution. BACKGROUND: On January 31, 2001, the Mayor and City Commission authorized the Administration to issue Request for Proposal No. 21-00101 (RFP), for the construction of the Normandy Isle Park and Pool Facility. Following four responses to the RFP on May 17,2001, the Administration established a seven member evaluation committee for the review, evaluation and recommendation of the received proposals. On September 5, 2001, the Mayor and City Commission approved and authorized negotiations with the top ranked firm of Regosa Engineering, and following value engineering sessions and approvals for additional required funding sources, the City passed and adopted Resolution No. 2002-24800 on March 20, 2002 awarding the construction contract of the Normandy Isle Park and Pool Facility to Regosa Engineering. Construction on the project started in June 2002 and has been proceeding on schedule with an anticipated substantial completion date of October 30,2003. I n order to supply the electrical power to the new park and pool facilities, Florida Power and Light ( FP&L) has to install a transformer on a pad with underground feeders within the park property. To energize the system, FP&L is requesting the City to grant an easement for the pad mount transformer, clearances and the underground transmission ducts area. ANALYSIS: Public Works has reviewed the proposed park plans and easement utilities and found no conflict with existing underground utilities or land use and, therefore, recommends granting a non-exclusive easement. The non-exclusive easement will be granted to FP&L for the installation and maintenance of an underground transmission system and a transformer on concrete pad within the easement area shown in the attached sketch and legal description. The easement will be valid for the duration of said transformer and facilities being in service and will revert to the City in case of removal of such electrical services. CONCLUSION: The Administration recommends the granting of the easement by the Mayor and City Commission to Florida Power & Light for the underground utilities and the transformer pad, and the execution and recording of said easement by the Mayor and City Clerk to allow energizing of the Normandy Isle Park and Pool Facility. WHEREAS, the City owns the Normandy Isle Park and Pool Faclities (Property); and WHEREAS, as part of the City's Parks and Recreation General Obligation Bond Parks Master Plan, the City initiated the improvements to the Normandy Isle Park and Pool Facilities; and WHEREAS, on March 16, 2001, the City issued RFP No. 21-00/01 for the construction of the Normandy Isle Park and Pool Facility; and WHEREAS, on March 20, 2002, following evaluations by a Selection Committee and negotiations with the contractors, the City passed and adopted Resolution No. 2002-24800 awarding Regosa Engineering, Inc. the construction contract for the Normandy Isle Park and Pool Facility; and WHEREAS, construction on the project started in June 2002 and has been proceeding on schedule with an anticipated substantial completion date of October 30,2003; and WHEREAS, in order to supply the electrical power to the Property, Florida Power and Light (FP&L) has to install a transformer on a pad with underground feeders at the Property; and WHEREAS, to energize the system, FP&L is requesting the City to grant the attached easement for the pad mount transformer and the underground transmission ducts area. Following four responses to the RFP on May 17, 2001, the Administration established a seven member evaluation committee for the review, evaluation and recommendation of the received proposals. On September 5, 2001, the Mayor and City Commission approved and authorized negotiations with the top ranked firm of Regosa Engineering, and following value engineering sessions and approvals for additional required funding sources, the City passed and adopted Resolution No. 2002-24800 on March 20, 2002 awarding the construction contract of the Normandy Isle Park and Pool Facility to Regosa Engineering. Construction on the project started in June 2002 and has been proceeding on schedule with an anticipated substantial completion date of October 30, 2003. In order to supply the electrical power to the new park and pool facilities, Florida Power and Light ( FP&L) has to install a transformer on a pad with underground feeders within the park property. OR BK 21~27 PG ~936 LAST PAGE f ... . , ANAL YSIS: Public Works has reviewed the proposed park plans and easement utilities and found no conflict with existing underground utilities or land use and, therefore, recommends granting a non-exclusive easement. The non-exclusive easement will be granted to FP&L for the installation and maintenance of an underground transmission system and a transformer on concrete pad within the easement area shown in the attached sketch and legal description. The easement will be valid for the duration of said transformer and facilities being in service and will revert to the City in case of removal of such electrical services. CONCLUSION: The Administration recommends the granting of the easement by the Mayor and City Commission to Florida Power & Light for the underground utilities and the transformer pad, and the execution and recording of said easement by the Mayor and City Clerk to allow energizing of the Normandy Isle Park and Pool Facility.
