ACTION: Discussion held. Resolution No. 2003-25262 adopted as amended. Motion made by Commissioner
Steinberg to extend the scope of services of the corridor up to 71st St. and to analyze what else could be done in the
area with a Joint Participation Reimbursement Agreement (JPA) that FDOT will pay for the study and the City of
Miami Beach will manage it; seconded by Commissioner Smith; Voice vote: 6-0; Absent Commissioner Cruz.
Javier Rodriguez from FDOT spoke.
First Motion:
Motion made by Commissioner Steinberg to direct FDOT to go ahead with the scope of services that was previously
prescribed for HNTB with the addition of the corridor up to 71St. to analyze what else could be done in the area and
stated that he will be happy to serve as the City Liaison; seconded by Commissioner Smith; Voice vote: 7-0.
Commissioner Garcia requested to include the review of the Fire Department Rules and Regulations in reference to
the use of the Flyover by fire tracks; the current overpass is too narrow for fire trucks.
Commissioner Gross stated that them will be a workshop when the plans are worked out.

Commissioner Gross asked Mr. Javier Rodriguez from FDOT if it would be a problem to have a set of the 90%
construction plans from FDOT to make them available for citizen's review. Fred Beckmann to handle.
Javier Rodriguez from FDOT responded "not at all".
Jorge Gonzalez, City Manager clarified that the City is getting a copy of the plans and is not having a workshop. He
stated that at the appropriate time when there is a Mitigation of Traffic (MOT) to discuss and plans that need to be
brought out then the City will have a workshop. He further clarified that there is no workshop promised except for
the one to discuss the MOT when the plans are at 90% completion.
Second Motion:
Motion made by Commissioner Steinberg to reconsider the previous motion. He stated that it would be foolish for
the City not to spend the $14,000 for the study and not have a cloud over it and then the City will go to FDOT with
the results since some of the citizens are concerned with FDOT doing the study.
Jorge Gonzalez, City Manager, suggested a Joint Participation Reimbursement Agreement (JPA) with FDOT

funding the study and allowing the City to manage it.
Javier Rodriguez from FDOT responded "yes" that FDOT will pay for the study and the City will manage it.
Third and Final Motion:
Motion made by Commissioner Steinberg to extend the scope of services of the corridor up to 71st St. and to
analyze what else could be done in the area with the JPA that FDOT will pay for the study and the City of Miami
Beach will manage it; seconded by Commissioner Smith; Voice vote: 6-0; Absent Commissioner Cruz.

A RESOLUTION OF THE MAYOR AND COMMISSIONERS
OF THE CITY OF MIAMI BEACH, FLORIDA, TO DIRECT
THE CITY MANAGER TO ENGAGE HNTB CONSULTANT
SERVICES FOR FURTHER STUDY AND ANALYSIS OF
THE REMOVAL OF THE 63u° STREET FLYOVER
WHEREAS the 63rd Street/Indian Creek Drive intersection is a major artery within the
Miami Beach roadway system;
WHEREAS the prior City Commission directed FDOT to replace the 63rd Street flyover
with an at-grade solution;
WHEREAS the prior City Commission's direction to remove the flyover was based on
the 1999 FDOT Study and two independent reviews of that Study;
WHEREAS, this City Commission charged Commissioner Steinberg with overseeing the
project;
WHEREAS under the Commission's charge Commissioner Steinberg reviewed the
1999 FDOT Study, the two reviews of that study and the 1994 FDOT Study;
WHEREAS, Commissioner Steinberg's review of the studies indicated inconsistencies
and errors;
WHEREAS, the inconsistencies Commissioner Steinberg discovered were as follows:
While the 1999 FDOT Study indicates the at-grade solution provides the
highest level of service, the 1994 FDOT Study indicates the at-grade
solution provides a lower higher of service than a flyover; however, the
1994 FDOT Study was not provided to the City's consultants during their
review of the 1999 FDOT Study;
While theproposed solution creates a signalized pedestrian crosswalk
across 63rdStreet on the West Side of Indian Creek Drive, the studies
failed to analyze its impact on levels of service;
While the various alternatives studied were suppose to examine
alternatives for the 63rd Street/Indian Creek Drive intersection, one of the
alternatives reduced the through lanes on North Bound Indian Creek Drive
at 65th Street from three (as it is now) to two;
While the at-grade solution relies on the removal of the left turning
movement on West Bound 63rd Street at Indian Creek Drive and its related
phase of the light and one of the alternatives with a flyover was suppose to
analyze a flyover without this movement and phase as well, the data
indicates that the analysis failed to remove the phase;
While FDOT's 1994 Study included mid-day analysis which indicated a
drop in the level of service for the intersection during non-peek times if
the currently proposed at-grade solution is installed, FDOT's 1999 Study
failed to include mid-day analysis;
WHEREAS, residents of the City, especially those in North Beach, rely on this
intersection regularly to travel to medical care, school, work, shopping, entertainment, the
airport, etc;
WHEREAS, this intersection's performance is a vital key to the economic future of
North Beach;
WHEREAS, the City's consultant who provided the more thorough review of the FDOT
Study has stated that the inconsistencies and errors discovered by Commissioner
Steinberg warrant further review;
WHEREAS, the City Manager negotiated a not to exceed cost of $13,657 with HNTB to
address the inconsistencies and errors after an initial estimate of $21,044;
WHEREAS, the City Manager has recommended that the City engage the consultant to
perfomi the necessary analysis;
WHEREAS, given the impact of the proposed construction on the mobility of our City's
residents and our City's economy and the long term impact of the selected solution for
the intersection, it is in the best interest of the City to spend the relatively nominal funds
needed to analyze the concerns raised;
NOW, THEREFORE, BE IT RESOLVED that the Miami Beach City Commission
directs the City Manager to engage HNTB Consultant Services pursuant to their May 13,
2003, Scope of Services.

A COST NOT TO EXCEED $13,657.00 FOR FURTHER
STUDY AND ANALYSIS OF THE REMOVAL OF THE
63rd STREET FLYOVER.
WHEREAS, the 63rd Street/Indian Creek Drive intersection is a major artery
within the Miami Beach roadway system; and
WHEREAS, in 2000, the prior City Commission directed FDOT to replace the
63rd Street flyover with an at-grade solution; and
WHEREAS, the City Commission's direction to remove the flyover at that time
was based on the 1999 FDOT Study and two independent reviews of that Study; and
WHEREAS, the City Commission has recently charged Commissioner Richard
Steinberg with overseeing the project; and
WHEREAS, under the Commission's charge, Commissioner Steinberg reviewed
the 1999 FDOT Study, the two reviews of that study, and the 1994 FDOT Study; and
WHEREAS, Commissioner Steinberg's review of the studies indicated
