RESOLUTION NO. 80-16217
A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA,
DIRECTING THE CITY ATTORNEY TO INITIATE
LITIGATION OR COOPERATE WITH ANY CITIZEN
WISHING TO INITIATE LITIGATION CHALLENG-
ING FLORIDA STATUTE 166. 043 WHICH
ESTABLISHES PROCEDURES FOR THE PASSAGE
OF ORDINANCES AND RULES IMPOSING RENT
CONTROL.
WHEREAS, Florida Statute 166. 043 provides that no
municipality shall adopt or maintain in effect any law, ordinance,
rule, or other measure which would have the effect of imposing
controls on rents unless such measure is approved by the voters
in such municipality; and
WHEREAS, Florida Statute 166. 043 further provides
that no controls shall be imposed on rents for dwelling units
located in luxury apartment buildings as defined by Section
166. 043 (4) , Florida Statutes; and
WHEREAS, there are a large number of persons living
within the City of Miami Beach on fixed incomes who are, there- ,
fore, particularly sensitive to the effects of inflation in
general and unconscionable and extraordinarily large increases
in rent in particular; and
WHEREAS, the City Commission determines there to be
a housing emergency so grave as to constitute a serious menace
to the general public and that rent controls are necessary and
proper to eliminate such grave housing emergencies; and
WHEREAS, such emergency is based solely upon local
conditions unique to the City of Miami Beach and cannot be dealt
with effectively and expeditiously because of the unreasonable
limitations established by Florida Statutes 166 . 043 as set forth
hereinabove.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Attorney be
authorized to initiate litigation or cooperate with any citizen
wishing to initiate litigation for the purpose of challenging
Florida Statute 166. 043 which establishes limitations upon the
imposition of rent controls.
