Resolution 80-16219 RESOLUTION NO. 80-16219 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO APPEAL CIRCUIT COURT CASE NO, 80-4422 AND CASE NO. 80-4545 , INVALIDATING THE ORDINANCES PROVIDING FOR A MORATORIUM ON CONDOMINIUM CONVERSIONS AND 18-MONTH LEASE EXTENSION FOR TENANTS . WHEREAS, two suits were brought against the City of Miami Beach seeking a Temporary and Permanent Injunction enjoining the City of Miami Beach from enforcing Ordinance No. 80-2197 or any other similar ordinance attempting to prevent the conversion of real property to condominium form of ownership; and WHEREAS , the Circuit Court of the Eleventh Judicial Circuit in and for Dade County has declared and determined that Ordinance No. 80-2197 of the City of Miami Beach to be illegal , void and unconsti- tutional; and WHEREAS , the City Commission of the City of Miami Beach has determined it to be in the best interest of the citizens of the City of Miami Beach to appeal said decision; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Attorney be authorized and directed to appeal the decision of the Circuit Court declaring that Ordinance No. 80-2197 and other similar ordinances regulating condominium conversions illegal , void and unconstitutional .
