RESOLUTION NO. 80-16232
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY
MANAGER AND CITY ATTORNEY TO NEGOTIATE THE TERMI-
NATION OF AN AGREEMENT BETWEEN THE CITY OF MIAMI
BEACH AND POST, BUCKLEY, SCHUH AND JERNIGAN, INC. ,
FOR CONSULTING SERVICES FOR THE DEVELOPMENT OF A
COMPREHENSIVE MASTER PLAN.
WHEREAS, the City of Miami Beach passed and adopted
Resolution No. 78-15771 authorizing the execution of an agreement
between the City of Miami Beach and Post, Buckley, Schuh and
Jernigan, Inc. , for consulting services for the development of a
Comprehensive Master Plan; and
WHEREAS, the City administration has been extremely
disatisfied with the work efforts of the Comprehensive Plan
consultants; and
WHEREAS, as to date, the professional planning services
provided has been grossly deficient, behind schedule, of low
quality, and in some cases , factually inaccurate; and
WHEREAS, the agreement with Post Buckley provides for
termination by either party by giving seven (7) days ' prior written
notice, in the event of substantial failure to perform in accordance
with the terms thereof; and
WHEREAS, it is the opinion of the administration that
Post Buckley, has substantially failed to perform such services
and recommends that the agreement be terminated;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: The City Commission of the City of Miami Beach, Florida,
pursuant to the terms of the contract entered into
between the parties on the 15th day of November, 1978 , hereby autho-
rizes the City Manager and City Attorney to give seven (7) days '
written notice of intention to terminate said agreement.
SECTION 2 : The City Commission of the City of Miami Beach, Florida,
finds and determines that it is in the best interest of
the City of Miami Beach, its taxpayers and citizens , to terminate
said contract.
SECTION 3 : That the City Manager and the City Attorney take all
necessary steps to recover as much of the total compen-
sation awarded to said consultant as possible.
PASSED and ADOPTED this 19th day of March , 1980 .
