A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, PETITIONING THE DADE
COUNTY DELEGATION TO THE FLORIDA LEGISLATURE
TO OPPOSE THE PASSAGE OF SENATE BILL 345 WHICH
WOULD AUTHORIZE THE COUNTY TO REGULATE AND
LICENSE TAXICABS WITHIN THE CITY OF MIAMI
BEACH.
WHEREAS , the Florida Legislature is presently considering
legislation which would permit Dade County to preclude and prohibit
municipal regulation of the taxicab industry within the City of
Miami Beach, thereby unreasonably and arbitrarily jeopardizing
the interest of all Dade residents of the incorporated areas; and
WHEREAS , the level of service rendered by the taxicab
industry adequately meets the needs of residents of and visitors
to both the incorporated areas and unincorporated area of Dade
County; and
WHEREAS, this present level of satisfactory service
has been achieved under a system of municipal and county taxicab
regulations which must continue in order to preserve and insure
the maintenance of the current level of satisfactory service;
and
WHEREAS, the proposed ordinance states that enforcement
shall be authorized by personnel of the OTA, the police forces of
the various municipalities in Dade County and by the Dade County
Public Safety Department, the proposed ordinance has no provision
for revenues to be returned to the City of Miami Beach; and
WHEREAS , the loss of the right to control of the taxicab
industry by the City Commission will cause tremendous financial
loss to the current holders of Miami Beach Certificates of
Convenience and Necessity, as well as to the City of Miami Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA:
Section 1. The Dade County Delegation to the Florida
Legislature is hereby strongly urged to reject that portion of
Senate Bill 345 or any other similar legislation which would
authorize the County to regulate and license taxicabs within
the City of Miami Beach.
Section 2. The City Clerk is hereby directed to
forward copies of the herein resolution to all members of the
Dade County Delegation to the Legislature.
