A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH AUTHORIZING SETTLEMENT STIPULATION
RELATING TO MILDRED S. FALK AND JACK J. FALK V. CITY
OF MIAMI BEACH, CASE NO. 78-6156 CA-16 .
WHEREAS, the City Attorney has negotiated a tentative agree-
ment with Philip A. Holtsberg, Esq. , Counsel for Plaintiffs ,
Mildred S. Falk and Jack J. Falk, et al. , concerning Plaintiffs '
suit against the City of Miami Beach, styled as Case No. 78-6156
CA-16 , relating to the transfer of bond fund moneys from one bond
fund account to another and recommends that the City enter into
said Settlement Stipulation; and
WHEREAS, the Order of the Circuit Court Judge approving such
Settlement Stipulation will not be subject to modification and
review; and
WHEREAS, the City Commission deems it to be in the best
interests of the City to enter into a Final Settlement Stipulation
as hereinabove set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, that the City Attorney be and he is
hereby authorized to enter into a final settlement as approved by
a Circuit Court Judge, and the Mayor, City Clerk, Finance Director,
and the City Attorney be and they are hereby authorized and directed
to comply with the Order of the Judge approving such Stipulation.
PASSED AND ADOPTED this 23rd day of April , 1980 .

The attorneys for the Plaintiffs and the Plaintiffs
in the above case have agreed to a dismissal of the 'r
suit in return for payment by the City of $3 , 618 which
would cover Plaintiffs ' fees and costs .
This office recommends approval.
