Resolution 80-16271 r RESOLUTION NO. 80-16271 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, URGING THE DADE COUNTY COMMISSION, PURSUANT TO THE AUTHORITY VESTED IN THEM BY SECTION 718 . 606 (6) (b) , F.S. , OF THE "ROTH ACT" , TO ADOPT AN ORDINANCE OR OTHER MEA- SURE EXTENDING THE 270-DAY EXTENSION PERIOD TO THE MAXIMUM PERIOD PROVIDED BY LAW. WHEREAS, the Commission finds that the conversion of rental housing units to condominium units has caused an emergency shortage of rental housing in the City of Miami Beach constitu- ting a crisis; and WHEREAS, the Commission recognizes the hardships caused by displacement of tenants, particularly those in low to moderate cost housing and those who are elderly, families with minor depen- dent children, the handicapped and the disabled; and WHEREAS, there exists a housing emergency so grave as to constitute a serious menace to the general public, and that such controls are necessary and proper to eliminate such grave housing emergency; and WHEREAS, Section 718 . 606 (6) (b) , F.S. of the "Roth Act" , provides that whenever a county determines that there exists within the county a vacancy rate in rental housing of three percent (3%) or less, the county may adopt an ordinance or other measure extending the 270-day extension period provided for in the "Roth Act" for an additional ninety (90) days; and WHEREAS, recent studies of the vacancy rates in rental housing on Miami Beach, as well as the county, have indicated that there exists a vacancy rate of less than three percent; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Miami Beach City Commission strongly urge that the Dade County Commission take all necessary steps to expeditiously implement the provisions of the "Roth Act" which provide for an additional ninety (90) day extension period. BE IT FURTHER RESOLVED that the City Manager notify the County Manager of this resolution, and request that it be placed on the agenda of the Dade County Commission forthwith.
