Resolution 80-16284 RESOLUTION NO. 80-16284 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, WAIVING COMPUL- SORY MEMBERSHIP IN THE CITY OF MIAMI BEACH EMPLOYEES ' BENEFIT PLAN BY REGULAR EMPLOYEE, WALTER IGNELL. WHEREAS, one WALTER IGNELL a regular employee of the City of Miami Beach, has filed with the City Commission of the City of Miami Beach a formal objection to the requirement of compulsory membership in the City of Miami Beach Employees ' Benefit Plan pursuant to Miami Beach City Code Article IV, Sec- tion 2-53 , on the basis of his religious beliefs and convictions; and WHEREAS, the Board of Trustees of the Retirement System for General Employees and Elected Officials of the City of Miami Beach has recommended to the City Commission of the City of Miami Beach that the requirement of compulsory membership in the City of Miami Beach Employees ' Benefit Plan by Walter Ignell be waived; and WHEREAS, the City Commission of the City of Miami Beach finds that the religious beliefs and convictions of Walter Ignell are sincere and that participation of Walter Ignell in the City of Miami Beach Employees ' Benefit Plan is in conflict with his reli- gious beliefs and convictions; NOW, THEREFORE, BE. IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the requirement of compulsory membership in the City of Miami Beach Employees ' Bene- fit Plan by Walter Ignell be and the same is hereby waived and the City Manager and the Board of Trustees of the Retirement System for General Employees and Elected Officials of the City of Miami Beach, Florida, are hereby authorized to take such action as will effectuate the waiver. Toal City Manager SUBJECT: WALTER IGNELL'S REQUEST TO BE REMOVED FROM THE EMPLOYEES' HEALTH PLAN ON THE GROUNDS OF RELIGIOUS BELTEFS OR CONVICTIONS. City employee Walter Ignell appeared before the Pension Board of the Retire- ment System for General Employees and Elected Officials of the City of Miami Beach at their April 29, 1980 meeting and requested to withdraw from the Employees' Health Plan on the grounds of religious beliefs. In compliance with the City Attorney's recommendation, Mr. Ignell presented a notarized letter stating his religious beliefs and holding the City harm- less as to any claims which may have been covered by the Employees' Health Plano The Pension Board moved to recommend to the City Commission thatMr. Ignell's request be complied with. The City Commission's authority to act on this issue comes from Chapter 2 of the "Code of the City of Miami Beach, Florida", Administration, Article IV Employees' Benefit Plan, Sec. 2-53 (b) Membership which provides: "persons who become regular employess of the City subsequent to January 5, 1952, shall automatically be included in the member- ship of the plan without further medical examination except that it shall not be compulsory for any regular employee to become a member if he files with the City Commission a formal objection on the grounds of religious beliefs or convictions." ADMINISTRATION RECOMMENDATION: To accept pension Board's recommendation and approve request.
