Resolution 80-16289 RESOLUTION NO . 80-16289 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, URGING THE UNITED STATES CONGRESS TO RELEASE DEPARTMENT OF INTERIOR LAND AND WATER CONSERVATION FUNDS AND URBAN PARK AND RECREATION FUNDS WHICH HAVE BEEN PREVIOUSLY BUDGETED AND APPLIED FOR. WHEREAS, President Carter has recommended that the Federal Government reduce spending in order to balance the Federal Budget; and WHEREAS, in order to accomplish these purposes, the Carter Administration has recommended the following dispropor- tionate reduction in the FY 80 and FY 81 Department of Interior Land and Water Conservation Funds and Urban Park and Recreation Funds: 1. LAWCON Funds - A rescission of $150 million of appropriated FY 80 funds, and reduction of another $150 million FY 81 of the LAWCON Program' s un- obligated funds as of March 31, 1980. If Congress concurs with the President ' s recommendation, Florida will lose $8 . 1 million portion of $9. 5 million 1980 allocation, and about $5 million of next year ' s anticipated allocation. 2. UPARR Funds - A rescission of all FY 80 obligated funds and no provision for funding of FY 81 funds. WHEREAS, the City of Miami Beach has participated in both the LAWCON and UPARR Programs; and WHEREAS, the City of Miami Beach has pending an application for $1. 3 million for LAWCON Funds to develop the new Oceanfront Linear Park; and WHEREAS, if the UPARR Funds are rescinded, the City ' s pending $444 ,640 Grant application to rehabilitate the 21st Street Community Center would not be considered; and WHEREAS, the United States Government has previously approved and provided funds for a five-phase Miami Beach. Hurricane Protection and Beach- Erosion Control Project, said funds in part are to be used to provide funds for the participation of the U. S. Army Corps of Engineers in the project; and WHEREAS, the City of Miami Beach passed and adopted a resolution on April 9, 1980 approving issuance of a permit for the fourth phase of the Dade County Beach Erosion Control and Hurricane Protection Project, MP-54; and WHEREAS, the United States of America, represented by the District Engineer of the United States Department of the Army, Corps of Engineers, Jacksonville District, Jacksonville, Florida, has advised the City of Miami Beach that the federal appropriations designated as 96X3122 (BEDAC 0250/284) and 96X8862 (FWDAC 0250/284) , have been rescinded; and OFFICE OF THE CITY ATTORNEY - 1700 CONVENTION CENTER DRIVE -MIAMI BEACH, FLORIDA 33139 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the United States Congress be and they are hereby emplored and urged to oppose any disproportionate reductions in the FY 80 and FY 81 Department of Interior Land and Water Conservation Funds, and Urban Park and Recreation Funds; and BE IT FURTHER RESOLVED that the City Clerk be and she is hereby authorized and directed to furnish a copy of this reso- lution to each member of the Florida Delegation to the United States Congress, and to the Speaker of the House of Representatives, and to the President of the United States Senate.
