Resolution 80-16300 RESOLUTION NO. 80-16300 A RESOLUTION AUTHORIZING ACCEPTANCE OF FINAL SETTLEMENT STIPULATION IN CONNECTION WITH WORKER' S COMPENSATION CLAIM OF ROBERT C . BULLARD AGAINST THE CITY OF MIAMI BEACH. WHEREAS, on August 23, 1977 , one ROBERT C. BULLARD, a former employee of the City of Miami Beach, suffered injuries to his lower back while driving a vehicle over rugged terrain ; and WHEREAS, said former employee , was required to undergo back surgery, and was given a permanency rating of 25% of the body; and WHEREAS, Risk Management Services, Inc. , has determined and recommended that it is in the best interest of the City to enter into a settlement under the provisions of F.S . 440. 20(10) , as amended; such settlement calls for the payment by the City to said former employee of the sum of $14 , 000 representing a final settlement of any and all past , present and future compensation and medical benefits due him under the Worker ' s Compensation Law, and a reasonable attorney' s fee to be $2 , 000 ; and WHEREAS, the Order of the Deputy Commissioner of Industrial Claims approving such settlement stipulation will not be subject to modification or review; and WHEREAS, the City Commission deems it to be in the best interest of the City to enter into a final settlement stipulation as hereinabove set forth; NOW, THEREFORE , BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, that Risk Management Services, Inc. , as the agent for the City of Miami Beach, is hereby authorized to enter into a final settlement as approved by a Deputy Commissioner of Industrial Claims and the Mayor, City Clerk, Finance Director , City Attorney and Risk Management Services , Inc. , be and they are here- by authorized and directed to comply with the Order of the Deputy Commissioner approving such stipulation. To&I FROM: City Manager SUBJECT: WORKER' S COMPENSATION CASE SETTLEMENT/ ROBERT C. BULLARD The City of Miami Beach employed a Mr. Robert C. Bullard in 1964 as a golf course attendant . On August 23, 1977, while working for the City, and driving a vehicle over rugged terrain the Claimant strained his lower back. In subsequent job-related injuries dated July 21 , 1973, May 24, 1974 , and March 10, 1978 the Claimant reinjured and retwisted the lower back area. As a result of these injuries , the Claimant was required to undergo back surgery and was given a permanency rating of 25% of the body. A 25% rating has a monetary value of $10,425. 00. The City of Miami Beach has already spent over $22 ,000 on this file. Based on these facts, the City Administration sought to close out this claim with the assistance of Risk Management Services , Inc. After a series of negotiations, an amount of $14, 000 ($1, 000 in permanent partial disability, and $13 , 000 in future medicals) was tentatively agreed to. Upon settlement of this claim the City will no longer have any exposure or liability in regard to future costs. The Claimant was retired on April 1 , 1980 on a service-related pension. ADMINISTRATION RECOMMENDATION It is recommended that the Mayor and City Commission approve the lump sum settlement of $14, 000 and an additional $2 , 000 for attorney fees for the final closure of the worker ' s comp- ensation case involving Robert C. Bullard. In consideration of this settlement , the City will no longer be held liable for any future worker' s compensation or medical costs in relation to the injuries described above.
