A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING
THE EXECUTION OF AN AGREEMENT BETWEEN THE
CITY OF MIAMI BEACH, FLORIDA, AND ZEV BUFMAN
ENTERTAINMENT, INC. , PROVIDING FOR PARTICIPA-
TION IN THE COST OF INSTALLING ADJUSTABLE
SOUND-ABSORBING MATERIALS AND ADDITIONS TO
THE SOUND SYSTEM IN THE THEATER OF THE PER-
FORMING ARTS.
WHEREAS , the City Commission of the City of Miami Beach
deems it in the best interest of the citizens of Miami Beach to
enter into an agreement with ZEV BUFMAN ENTERTAINMENT, INC. , the
terms of which are familiar to the City Commission; and
WHEREAS , the City Manager recommends the City enter
into said agreement, a copy of which is attached hereto and
incorporated herein, and the City Attorney has approved same as
to legal form as sufficiency;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the City
Manager be and is hereby authorized and directed to enter into
said agreement for and on behalf of the City of Miami Beach.

Dear Mr. Bufman:
This Letter of Agreement is to confirm your offer, as set forth
in Mr. Joel Arnold' s letter of May 9 , 1980 (a copy of which is
attached hereto and made a part hereof) , to unconditionally
undertake the underwriting of twenty-five percent (25%) of the
cost of installing adjustable sound-absorbing materials. and
additions to the sound system as described in paragraphs A and
E (2) (4) and (7) of the Klepper Marshall King report dated
April 29, 1980, which was approved by the City Commission on
May 7th. -
Payment of. your portion of the cost shall be paid to the City
in sixty (60) equal consecutive monthly installments, commenc-
ing one month after the completion of the project.
This offer is conditioned upon substantial completion of the
Project prior to the opening of the. Fall Season, October 21,
1980. ' However, it is agreed that a delay in the completion of
the Project due to circumstances beyond the control of the City
will not give rise to cancellation of this Agreement.
