A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA
AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT WITH THE STATE
OF FLORIDA BOARD OF TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND FOR
A PORTION OF SUBMERGED PROPERTY LOCATED ON INDIAN CREEK ADJACENT TO THE
CITY'S PROPOSED SAILPORT SITE.
WHEREAS, The City of Miami Beach owns the following described
property:
Section II, Township 53-42, Lots 1 thru 6,
Block M7693 Corrected Plat Atlantic Heights,
Plat Book 9 Page 14, Dade County, Florida;
and
WHEREAS, the City has deemed this property to be an appropriate location
for a small sailport facility; and
WHEREAS, construction of said sailport facility is consistent with the
City's adopted Recreation and Open Space Master Plan; and
WHEREAS, the City has applied for permits from the Army Corps of Engineers,
State Department of Environmental Regulation, and State Department of Natural
Resources for the construction of said sailport facility; and
WHEREAS, the State of Florida owns the following described submerged property
adjacent to the City's proposed sailport site:
A parcel of submerged sovereignty land in Indian
Creek, Biscayne Bay, in Section 11, Township 53
South, Range 42 East, Dade County, Florida, more
particularly described as follows:
Commence at a corner of a concrete bulkhead bound
in an Easterly line and marking the Southwesterly
corner of Lot 6, Block M7693, and marking the
Southeasterly corner of submerged lands hereby
described and the Point of Beginning; thence run
along a Westerly line parallel in direction with
the South most boundary line of Lot 6, 64 feet;
thence turning a deflectiop angle of 56°30' to the
right, along the submerged lands of Indian Creek,
188 feet; thence turning a deflection angle of 90°
to the right, along the submerged lands of Indian
Creek, 83 feet, more or less, to a concrete bulk-
head in the West most boundary of Lot 1 of the land
of the City of Miami Beach, 220 feet, more or less,
to a corner of a concrete bulkhead in the boundary
of Lot 6 of the lands of the City of Miami Beach;
thence Southwesterly along the West most boundary
of Lot 6, 34.97 feet to the Point of Beginning,
containing 17,120 square feet, more or less;
and
WHEREAS, the City wishes to construct docking facilities on the above
described State owned property for the launching of small sailboats; and
WHEREAS, the Board of Trustees of the Internal Improvement Trust Fund
has approved a lease of the above described submerged property for a period
of 22 years, waiving all fees;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA that the City Manager is hereby authorized to execute an
agreement with the Board of Trustees of the Internal Improvement Trust Fund
for the lease of State owned submerged property located on Indian Creek adjacent
to the City's proposed sailport site.
