Resolution 80-16345 RESOLUTION NO. 80-16345 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH FINST DEVE- LOPMENT, INC. , PROVIDING FOR LEASE OF TWELVE PARKING SPACES AT 68TH STREET AND INDIAN CREEK DRIVE. WHEREAS, for the reasons more particularly set forth in Commission Memorandum No.8371 , the City Commission of the City of Miami Beach finds it in the best interest of the City to enter into an agreement with Finst Development, Inc. , for the purpose of leasing twelve spaces in the City' s off-street parking lot at 68th Street and Indian Creek Drive twenty-four hours a day, seven days a week; and WHEREAS, the City Manager recommends the City enter into said agreement, and the City Attorney has approved same as to form and legal sufficiency; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COM- MISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Mana- ger be and he is hereby authorized and directed to execute and deliver said agreement for and on behalf of the City of Miami Beach, Florida. Finst Development, Inc. , of Miami Beach is in the process of con- structing a building on 68th Street and Indian Creek Drive. They have requested to lease twelve (12) spaces in our off-street parking lot at 68th Street and Indian Creek Drive twenty-four hours a day, seven days a week. A rental charge of $250 for each of the twelve spaces or $3,000 per year has been agreed to by Finst Development, Inc. , and the City. The lease is to become effective August 21, 1980. No heavy equip- ment will be allowed on the portion of the lot opened to the public; the lot to be restored to original condition upon termination of lease and should be inspected by the City. In addition, Finst Development, inc. will satisfy the following: 1. Worker's Compensation per statutory limits of the State of Florida. 2. Comprehensive General Liability insurance with single limits of $500,000 for Bodily Injury and Property Damage. 3. The City must be named as an Additional Insured on the above policy (excluding Worker's Compensation) . 4. The City must receive thirty (30) days prior written notice of cancellation on above policies. 5. The insurance companies must be rated A:X as per Best Insurance Guide. The contractor acknowledges the City will not be held responsible for his property located or left on our premises stated above. The property leased will be fenced in. No deliveries of any kind will be made to the premises leased from the lot open to the public. ADMINISTRATION RECOMMENDATION: The City recommends approval of the lease with Finst Development, Inc. It would be in the best interest of the City and will not be detrimen- tal to the Metered Parking System. Box 41-G Miami Beach, FL 33141 Dear Mr. Finvarb: This is to confirm a conversation between yourself and Mr. Harold Toal, City Manager, on July 12, 1980, regarding your use of Municipal Parking Lot 21X, Indian Creek Drive and 68th Street, South half of Lot Meter #1 through #12. Approval of such use by the City is predicated upon Finst 's compliance with the following terms as required on contracts insuring the City of Miami Beach: 1. Worker ' s Compensation per statutory limits of the State of Florida. 2. Comprehensive General Liability insurance with single limits of $500,000 for Bodily Injury and Property Damage. 3. The City must be named as an Additional Insured on the above policy (excluding Worker 's Compensation) . 4. The contractor agrees to be personally liable for any damage to the City property being leased by his negligence and/or his sub- contractors. The property leased will be fenced in. No heavy equipment will be allowed on the portion of the lot open to the public. Lot is to be restored to original condition prior to termination of lease, and should be inspected by the City. No deliveries of any kind will be made to the premises leased from the lot open to the public. Compliance with the foregoing must be documented by appropriate certificates. It is further understood and agreed that the terms and conditions of the letter of July 3, 1980, from Finst Develop- ment , Inc. , to the City of Miami Beach, are incorporated by reference and made a part hereof .
