Resolution 80-16430 RESOLUTION NO. 80-16430 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RETROACTIVELY AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH MIAMI BEACH COMMUNITY MENTAL HEALTH CENTER, INC. , FOR THE LEASE OF FACILITIES LOCATED AT 3602 COLLINS AVENUE, MIAMI BEACH, FLORIDA, FOR USE AS A SUBSTANCE ABUSE PROGRAM. WHEREAS, for the reasons more particularly set forth in Commission Memorandum No. 8504 , the City Commission of the City of Miami Beach, Florida finds it in the best interest of said City to enter into an agreement with the Miami Beach Community Mental Health Center, Inc. , a private not for profit division of the Miami Jewish Home for the Aged, for the purpose of leasing a certain parcel of land and facilities at 3602 Collins Avenue, Miami Beach , Florida , for use as a substance abuse program; and WHEREAS, the City Manager recommends the City enter into said Agreement, and the City Attorney has approved same as to form and legal sufficiency; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City Clerk be and they are hereby authorized and directed to execute and deliver said Agreement for and on behalf of the City of Miami Beach, Florida. OFFICE OF THE CITY MANAGER CITY HALL HAROLD T.TOAL 1700 CONVENTION CENTER DRIVE CITY MANAGER TELEPHONE: 673-7010 COMMISSION MEMORANDUM NO. t51.0 DATE: October 15 , 1980 TO: Mayor Murray Meyerson and b rs of the pt\tyC mmission FROM: afold TToat City Manager SUBJECT: LEASE AGREEMENT WITH MIAMI BEACH COMMUNITY MENTAL HEALTH CENTER, INC. , Pursuant to the discussion at the June 18 , 1980 Commission meeting, the Administration has prepared the attached Lease Agreement for the use of the City-owned property at 3602 Collins Avenue for Mimai Beach Community Mental Health Center, Inc. This Agreement provides for substance abuse counselling activities to be held at the facility for a period of one ( 1 ) year commencing on July 1 , 1980 and terminating June 30 , 1981 at the nominal rental rate of $1 . 00/year. The counselling activities will be specifically earmarked for Miami Beach residents who are drug and alcohol dependent to the point where it has become a disruptive influence in their lives. Miami Beach Community Mental Health Center , Inc. will be allowed to use only the southeast corner building of the facility for these purposes , and should they want to provide expansionary or ancillary services they will be required to receive prior approval from the Administration and the City Commission. This agreement provides for the City to incur water, gas and electrical costs at the facility up to an amount not to exceed $5 ,000 (analysis of past bills showed a monthly billing rate of $386/month or $4 ,362/year . This amount was adjusted to $416/mo or $5 ,000/year due to inflationary increases) . Although the Agreement is for a one-year period of time, there shall be a 90-day termination clause that may be revoked by both parties . The Administration, as part of its routine close-out procedures for the Operation Re-Entry program, determined that there was some $14 ,000 set aside in a special trust account . These funds were derived from client fees which were collected due to federal guidelines which mandate that these fees be paid to help offset operating expenses. These funds cannot be used for any other purposes other than program-related costs. It is therefore recommended that these funds be used to defray some of Miami Beach Community Mental Health Center, Inc. ' s initial start-up operating costs for such items as repairs to the facility, capital equipment, and other related cost elements. It is recommended that the $5 ,000 for water, gas and electrical costs that the City will incur be charged to this special trust account. Therefore , no general fund revenues will be used to fund this program. These funds shall remain within the City of Miami Beach ' s financial structure and shall be disbursed only upon adequate documentation of utility charges. Vp014 ADMINISTRATION RECOMMENDATION It is recommended that the Mayor and City Commission adopt the attached resolution authorizing the execution of a Lease Agreement with Miami Beach Community Mental Health Center , Inc. for the previously specified purposes. Furthermore , the Administration shall be instructed to disburse those trust funds in accordance with the above-mentioned procedures.
