RESOLUTION NO. 80-16458
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING
THE REASSIGNMENT OF THAT PORTION OF THE
WATER AND SEWER SERVICE AREA ON FISHER
ISLAND WHICH IS PRESENTLY WITHIN THE AREA
ASSIGNED TO THE CITY OF MIAMI BEACH TO THE
MIAMI/DADE WATER AND SEWER AUTHORITY.
WHEREAS, on September 4 , 1980 , Island Developers, Ltd.
and Fisher Island Associates, Ltd. , petitioned the Metropolitan
Dade County Water and Sewer Board to reassign that portion of the
service area on Fisher Island which is presently within the area
assigned to the City of Miami Beach, and that said area be granted
to the Miami/Dade and Water Sewer Authority (WASA) ; and
WHEREAS, the Metropolitan Dade County Water and Sewer
Board passed and adopted Resolution No. 80-74 requesting the City
of Miami Beach to consider releasing to WASA that portion of the
service area on Fisher Island that is located within the limits of
the City; and
WHEREAS, the City Manager has reviewed the request and
has no objection to the transfer of the Fisher Island service area
to WASA providing the following criteria are met :
1 . That the City' s 8-inch water main, currently located
with the proposed Port of Miami expansion area , be increased to a
20-inch main and that such cost be paid by Fisher Island developer
or the Port Authority.
2. That WASA provide additional service to the City of
Miami Beach from the new 20-inch water main on the Port expansion
and install the required meter at no cost to the City. In turn the
City will deed all existing rights and facilities servicing Fisher
Island to WASA.
3. That WASA shall continue to serve existing customers
on Fisher Island within the City limits of the City of Miami Beach,
without charge for main extensions or additional hookup. Also,
such existing customers shall pay the same rate per thousand
gallons charged to WASA customers outside the City limits of
Miami .
4. That all undeveloped land on Fisher Island within
Miami Beach City limits would be serviced by WASA, at no addi-
tional cost other than the normal main extensions and hookup
charges to customers outside the City limits of Miami .
5. That the City' s authorization to transfer such service
of Fisher Island to WASA shall not be construed as a waiver of any
right the City may have to bring an action against the Developer or
any other party for damages arising out of the City' s hookup to Vir-
ginia Key;

WHEREAS, the City Manager has no objection to the transfer
of sanitary sewer service on Fisher Island to WASA provided the
developer properly compensates the City for expenditures of the
transmission facilities to Virginia Key as set forth in Commission
]orrected Memorandum No. -8-5446; (Memo 8545 dated 11/5/80)

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Metropolitan Dade County
Water and Sewer Board be advised that the City Authorizes the
reassignment of that portion of the water and sewer service area on
Fisher Island which is presently within the area assigned to the City
of Miami Beach;
BE IT FURTHER RESOLVED that such approval is conditioned
upon the acceptance of those conditions set forth herein.

SUBJECT : Proposed Transfer of Water and Sewer Service Area on
Fisher Island from the City of Miami Beach to Miami
Dade Water and Sewer Authority by the Metropolitan
Dade County Water and Sewer Board
Also, the City would be relieved of the requirement of appearing
before the Metropolitan Dade County Water and Sewer Board to establish
a separate water rate for Fisher Island, which is costly.
In reference to the sanitary sewer, the Administration would have no
objection to the takeover of sanitary sewer service on Fisher Island
by WASA provided the developer properly compensates the City for ex-
penditures of the transmission facilities to Virginia Key, as they
were never contemplated to tie into the transmission system. The
applicable cost to the developer is calculated as follows :
1. Total Flow of Fisher Island 864,000 Gal. /Day = 2. 737
Costs of system paid by City of Miami Beach (subject to audit)
Principal & Interest paid off as of 10/1/80 $ 241,211.07
Principal & Interest to be paid off by City
of Miami Beach 7,426,973.50
TOTAL COST. . . . . . . $ 7,668,184.57
Total Cost (7 of flow by Fisher Island) = 209,341.44
Also, WASA will be responsible for their proportionate share
of maintenance cost of the transmission system from Fisher
Island to Virginia Key.
2. All undeveloped land on Fisher Island within Miami Beach City
limits would be serviced by WASA at no additional cost , other
than the normal main extensions and hookup charges to cus-
tomers outside the City limits of Miami.
The Administration is negotiating the possible purchase of the trans-
mission facility on Miami Beach to Virginia Key with the Miami-Dade
Water and Sewer Authority. The City of Miami Beach would be paid
for its cost and WASA would be responsible for operational and main-
tenance cost. The Miami-Dade Water and Sewer Authority would then
service the four municipalities to the north and the City would be
relieved of the requirement of appearing before the Metropolitan Dade
County Water and Sewer Board to establish a separate sewer rate out-
side out City limits , which is costly. Should our negotiations be
concluded and acceptable by the Commission, the above would be moot .
The Administration can see no objection to allowing the jurisdiction
to pass to Miami-Dade Water and Sewer Authority providing the above
safeguards are part of that transfer.
Attached is a sketch showing the service area and the facilities
existing and proposed to serve the area .

SUBJECT: Proposed Transfer of Water and Sewer Service Area on

Dade County Water and Sewer Board
The developers of Fisher Island have requested Metropolitan Dade
County Water and Sewer Board to remove their area from the juris-
diction of Miami Beach and have the Miami-Dade Water and Sewer
Authority provide them with water and sewer service . The Board, at
its meeting of September 25 , 1980, passed Resolution Number 80-74,
copy attached, requesting that the Miami Beach City Commission con-
sider its willingness to release that portion of the service area on
Fisher Island which is located within the limits of the City and if
the City Commission makes no response, they will consider that the
City has no objection to releasing the service area to WASA. Their
Board will again hear this matter at its meeting of October 30, 1980.
The Administration has reviewed this request and in regard to the water
service , has no objection to the transfer of the Fisher Island Service
Area to WASA, providing the following criteria is met :
1. That the City's 8-inch water main that would remain in
the Port of Miami expansion be increased to a 20-inch
main and the cost involved be paid by the Fisher Island
developer, WASA, or the Port Authority.
2 . That WASA provide an additional service to the City of
Miami Beach from the new 20-inch water main on the Port
expansion and install the required meter at no cost to
the City. In turn the City will deed all existing rights
and facilities servicing Fisher Island to WASA.
3. That WASA would continue to serve existing customers on
Fisher Island within the City limits of the City of Miami
Beach, without charge for main extensions or additional
hookup. Also, existing customers within the City limits
will pay the same rate per thousand gallons charged to
WASA customers outside the City limits of Miami.
4. That all undeveloped land on Fisher Island within Miami
Beach City limits would be serviced by WASA, at no ad-
ditional cost other than the normal main extensions and
hookup charges to customers outside the City limits of
Miami.

service point , help to improve the fire flow requirements on Terminal
Island, and supply Palm, Hibiscus , and Star Islands in the event
there is a water break on MacArthur Causeway west of Palm Island.
Also, the City would be relieved of the requirement of appearing
before the Metropolitan Dade County Water and Sewer Board to establish
a separate water rate for Fisher Island, which is costly.

within the City limits will pay the same rate per thousand
gallons charged to WASA customers outside the City limits
of Miami.
4. That all undeveloped land on Fisher Island within Miami
Beach City limits would be serviced by WASA, at no
additional cost other than the normal main extensions
and hookup charges to customers outside the City limits
of Miami, provided the customers ' use of the property is
in accordance with City of Miami Beach Zoning as of the
comssiottdate of transfer from Miami Beach jurisdiction for water
