RESOLUTION NO. 81-16518
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, REQUESTING THE FLORIDA
LEGISLATURE TO CONSIDER A CONSTITUTIONAL AMENDMENT
RESTORING AND ESTABLISHING MUNICIPAL COURTS.
WHEREAS, Article V of the Constitution of the State of
Florida abolished or terminated all municipal courts in the State
of Florida; and
WHEREAS, the City Commission of the City of Miami Beach
desires to enforce the Charter and Code of the City of Miami Beach
in a manner consistent with the needs of the City and its consti-
tuents; and
WHEREAS, the City Commission of the City of Miami Beach
has created, pursuant to Article V, Section 20 of the Constitution
of the State of Florida, and Section 34. 13 (5) Florida Statutes , the
office of Municipal Prosecutor, to prosecute violations of the Code
of the City of Miami Beach; and
WHEREAS, the City Commission of the City of Miami Beach
has been informed that the government of Dade County is considering
legislation which might preclude or preempt a City Code Enforcement
Board; and
WHEREAS, the City Commission has determined that the pre-
sent County Court system due to pressures of jail overcrowding and
Federal Court regulation thereof, excessive caseloads, and calendar
backlog, is not in the best position to respond to the municipality ' s
needs in the area of Code Enforcement;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Florida Legislature
is hereby requested to consider a Constitutional Amendment to Article
V of the Constitution of the State of Florida which would permit muni-
cipalities to create and establish municipal courts to hear and
determine matters pertaining to the charters and codes of the muni-
cipality.
