A RESOLUTION CALLING UPON METROPOLITAN DADE
COUNTY TO DISAPPROVE THE ADOPTION OF ITS
PROPOSED HISTORIC PRESERVATION ORDINANCE;
OR IN THE ALTERNATIVE, TO EXEMPT THE CITY
OF MIAMI BEACH FROM ITS PROVISIONS; OR FURTHER
IN THE ALTERNATIVE, ALLOW THE CITY OF MIAMI
BEACH TO TAILOR A HISTORIC PRESERVATION
ORDINANCE THAT MEETS THE NEEDS OF THIS COM-
MUNITY AND NOT ONE STRUCTURED BY DADE COUNTY
OR SUBJECT TO ITS APPROVAL.
WHEREAS, Metropolitan Dade County is considering final
passage of a Historical Preservation Ordinance on February 17 ,
1981; and
WHEREAS, said Ordinance assumes jurisdiction and control
of all historically designated property in both the incorporated
and unincorporated areas of Dade County; and
WHEREAS, the only method by which the City of Miami
Beach may preclude the enforcement of the proposed County
Ordinance within its corporate limits, is by the adoption of
Municipal Ordinance subject to Dade County standards and
approval; and
WHEREAS, the City of Miami Beach consists of seven
square miles; one of which is officially designated historically
significant by its registration on the National Trust for Historic
Preservation; and
WHEREAS, said historically designated square mile contains
approximately 500 structures that would be affected by the proposed
Ordinance; and
WHEREAS, the composition and complexion of the City
of Miami Beach is unique among the cities in Dade County; it
should not be involuntarily subjected to the provisions of an
Ordinance not specifically designed to meet its needs; and
WHEREAS, the City of Miami Beach should be allowed to
adopt a Historical Preservation Ordinance that is individualized
and localized to meet the the needs of this community, and not
one structured by Dade County standards and subject to Dade County
approval;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Metropolitan Dade
County Commission reject its proposed Historic Preservation ordinance;
or in the alternative, exempt the City of Miami Beach from its pro-
visions; or further in the alternative, allow the City of Miami Beach
to adopt an Historical Preservation Ordinance specifically designed
