REG/Ic Attachment F:\CLER\$ALL\LILIA\LTC's-Transmittal's\Resolution 2019-029 City of Hallandale.docx 1 RESOLUTION NO. 2019-029 2 3 A RESOLUTION OF THE MAYOR AND CITY COMMISSION 4 OF THE CITY OF HALLANDALE BEACH, FLORIDA 5 URGING THE STATE LEGISLATURE AND FEDERAL 6 GOVERNMENT TO INITIATE A STUDY OF THE HEALTH 7 EFFECTS OF SMALL CELL TOWERS BUILT TO 8 ACCOMMODATE 5G TECHNOLOGY AND TO DEVELOP 9 INSTALLATION GUIDELINES PROTECTING THE HEALTH 10 AND WELFARE OF RESIDENTS; PROVIDING FOR AN 11 EFFECTIVE DATE. 12 13 WHEREAS, small cell wireless equipment is designed to boost cellular service 14 from the existing wireless carriers and will enable those carriers to implement 5G 15 technology by placing these installations on existing streetlights and utility poles; and 16 17 WHEREAS, concerns have been raised about the health risks of 5G technology 18 including small cell installations. Many studies have linked low-level wireless radio 19 frequency radiation exposures to adverse biological effects including DNA single and 20 double strand breaks, oxidative damage, disruption of cell metabolism, increased blood 21 brain barrier permeability, melatonin reduction disruption to brain glucose metabolism and 22 generation of stress proteins. This list warrants additional scientific studies before 23 residents are put at risk; and 24 25 WHEREAS, the health hazards of 5G technology have been intensely debated at 26 the federal level before Congress and the Federal Communications Commission (FCC). 27 There does not appear to be any widely accepted definitive scientific study that proves one 28 way or the other whether small cell installations— emitting extremely high or "millimeter 29 wave" frequencies above 24 GHz— may have an adverse health impact, although in 2011 30 the World Health Organization classified radio frequency radiation as a possible 2B 31 carcinogen: and 32 33 WHEREAS, the only applicable FCC standards for radio-frequency radiation 34 emissions were set in 1996 and did not consider the use of modern wireless equipment 35 like small cells that will be located close to residences. Mere compliance with the FCC's 36 outdated standards does not assure safety; and 37 1 File No. 19-127 RESO NO. 2019-029 38 WHEREAS, the State of Florida has preempted local governments from regulating 39 the installation of small cells as it relates to their potential health effects or proximity to 40 residential areas; and 41 42 WHEREAS, the FCC adopted regulations in 2018 that are intended to facilitate the 43 installation of 5G technology "underscore[ing] the FCC's commitment to ensuring that the 44 United States wins the global race to 5G," as stated in the FCC Press Release dated 45 September 26, 2018; and 46 47 WHEREAS, global communications and technological advancements are important 48 components of the state and federal economy but need not come at the expense of the 49 public's health. As the world's leading economy, the United States can and should "win 50 the global race" while protecting its residents from potential long term health effects that 51 will only further harm the economy in the future; and 52 53 WHEREAS, the FCC's action allows private cell providers the right to put antennas 54 and transmission control boxes on city-owned streetlight poles and privately-owned utility 55 wood poles subject to only minimal limitations. This means that a 5G antenna could be 56 mounted on the streetlight or utility pole in front of a resident's home, and there would be 57 little the resident could do about it. Given the health concerns described above, the City 58 believes this should cause great concern for all City residents; and 59 60 WHEREAS, the Mayor and City Commission hereby find it is in the best interest of 61 the residents to urge the state and federal governments to initiate independent 62 scientifically reliable studies of the health effects of small cell wireless and 5G technology 63 on residential populations and develop guidelines for the installation of this technology that 64 will protect the health and welfare of the public. 65 66 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY 67 COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA: 68 69 SECTION 1. Each of the above recitals are hereby incorporated herein. 70 2 File No 19-127 RESO NO. 2019-029 71 SECTION 2. The Mayor and City Commission hereby urge the state and federal 72 governments to initiate independent scientifically reliable studies of the health 73 effects of small cell wireless and 5G technology on residential populations and 74 develop guidelines for the installation of this technology that will protect the health 75 and welfare of the public. 76 77 SECTION 3. The City Commission hereby directs the City Clerk to transmit a copy 78 of this Resolution to all appropriate entities. 79 80 SECTION 4.
