A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND CONTRACT FOR THE SALE
OF PARTS FOR VAGABOND-WHEELED REFUSE CARRIERS
TO THE CITY OF ROCKLEDGE, FLORIDA, FOR A SUM NOT
LESS THAN $5 , 000 .
WHEREAS, the City Commission has been advised by the City
Manager that the City is in possession of parts for approximately
7 , 000 (80-gallon) vagabond wheeled refuse containers; and
WHEREAS, the City Commission is advised that the City of
Miami Beach has no use for said containers, which are in a highly
deteriorated condition; and
WHEREAS, the City Commission believes it is in the public
interest to dispose of such surplus and damaged property to other
municipalities and local governments which have use for such sup-
plies; and
WHEREAS, the City of Rockledge desires to purchase and use
said refuse carrier parts for its own refuse dumping program;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager is autho-
rized to waive City bidding requirements and to negotiate and con-
tract for the sale of said carrier parts to the City of Rockledge,
Florida, for a sum not less than $5 ,000.

This agreement entered into this 16th day of April ,
1981, between the City of Miami Beach, a municipal corporation,
situated in Dade County, Florida and the City of Rockledge , a
municipal corporation, situated in Brevard County, Florida.
WITNESSETH :
WHEREAS , the City of Miami Beach owns approximately 7 ,000
Vagabond 80-gallon wheeled refuse containers and assorted parts
located on City owned property west of the building at 350 Alton
Road and the City property commonly known as the Ojus property; and
WHEREAS, the City of Miami Beach no longer has a need for
said containers ; and
WHEREAS, the City of Rockledge presently has a need for
the said containers;
NOW, THEREFORE, the City of Miami Beach in consideration
of the sum of Six Thousand Five Hundred Dollars ( $6 ,500 . 00) does
hereby agree to transfer all right and interest in said containers
to the City of Rockledge.
This Agreement is made by and between the City of Miami
Beach and the City of Rockledge upon and subject to the following
conditions:
1. The City of Miami Beach will have the res-
ponsibility to load the containers and parts.
2 . The City of Rockledge has the right to
reject any containers or parts that it deems to
be of no value .
3 . The City of Miami Beach will have the res-
ponsibility to dispose of said rejected con-
tainers and/or parts at its expense.

4 . The terms of this contract must be ful-
filled
ul-filled by both parties within sixty (60) days of
its execution or else the contract will be
deemed null and void.
