RESOLUTION NO. 81-16649
RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA TO HOLD
HARMLESS THE STATE DEPARTMENT OF NATURAL
RESOURCES, LAW ENFORCEMENT DIVISION, IN
ORDER TO SECURE WATERWAY MARKER PERMITS.
WHEREAS, Chapter 16N-23 of the Rules of the Florida
Department of Natural Resources, known as "Uniform Waterway
Markers in Florida Waters" , requires the submission of a hold-
harmless agreement prior to issuance of a permits for waterway
markers, and;
WHEREAS, the City Commission of the City of Miami
Beach, Florida deems it to be in the best interest of its
citizens to have such waterway markers;
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the City of Miami Beach
does hereby agree to hold harmless the Department of Natural
Resources, Division of Law Enforcement, from fault with respect
to any claim or claims arising from alleged negligence in the
placement, maintenance or operation of waterway markers approved
pursuant to 16N-23 "Uniform Waterway Markers in Florida Waters . "

1981.
