A RESOLUTION PROVIDING THAT THE CITY-OWNED PROPERTY AND
PUBLIC RIGHTS-OF-WAYS THAT FALL WITHIN THE BOUNDARIES
OF THE BEACHFRONT PARK AND PROMENADE SHALL BE RETAINED
AND PRIMARILY USED FOR PUBLIC RECREATIONAL BEACH ACCESS
IN CONNECTION WITH THE BEACHFRONT PARK AND PROMENADE
DEVELOPMENT, FUNDED BY THE LAND AND WATER CONSERVATION
FUND, DADE COUNTY AND THE CITY OF MIAMI BEACH; FURTHER
PROVIDING, THAT THE USE OF SAID PROPERTY SHALL NOT BE
DISCONTINUED OR ALTERED WITHOUT PRIOR APPROVAL FROM THE
DEPARTMENT OF NATURAL RESOURCES AND THE HERITAGE CONSER-
VATION AND RECREATION SERVICE.
WHEREAS, the City of Miami Beach has received $1,439,636.80 of Land and
Water Conservation Grant Funds to plan and construct a beachfrontp ark and prome-
nade- and,
WHEREAS, the City of Miami Beach has received $250,000.00 from Dade
County's Decade of Progress Bond Funds to plan and construct said '

ark project;

and,
WHEREAS, the City of Miami Beach has authorized the sale of local bonds
in the amount of $1,249,636.80 to plan and construct saidark project; and
WHEREAS, the City of Miami Beach has established the boundaries of said
park project as illustrated in Exhibit A; and,
WHEREAS, Dade County has passed a resolution authorizing execution of a
joint application with the City of Miami Beach to the Heritage Conservation
g and
Recreation Service for Urban Parks and Recreation Grant Funds;
NOW, THEREFORE, BE IT DULY RESOLVED by the City Commission of the City of
Miami Beach, Florida, that City-owned property and public right-of-ways that fall

within the boundaries of the Eeachfront Park and Promenade, as described in Exhibit

A attached hereto, shall be retained and primarily used for public recreational
beach access in connection with the Beachfront Park and Promenade development being

funded by the Land and Water Conservation Fund, Dade County, and the Cityof Miami
rel
Beach; and further providing that the use of said property shall not be discontinued
or altered without prior approval from the Department of Natural Resources and the
Heritage Conservation and Recreation Service.
