A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, REQUESTING FEDERAL
LEGISLATION TO CONTROL CONDOMINIUM CONVERSIONS.
WHEREAS, condominium conversions in this and neighboring
Florida communities endanger the public health, safety and welfare
by causing evictions and a harassment of elderly and low-income ten-
ants; and
WHEREAS, thousands of such tenants in this and neighboring
communities have faced eviction and harassment by developers seeking
to convert rental dwellings into condominium parcels; and
WHEREAS, the Florida Legislature has failed or refused to
protect the health, welfare and safety of these tenants from unscru-
pulous practices by condominium converters; and
WHEREAS, the Florida Courts have held that Florida munici-
palities are not permitted to impose restrictions or moratoria on
conversions; and
WHEREAS, the victimization of elderly and low-income ten-
ants by condominium converters is a national scandal, and has caused
and continues to cause suffering, including economic, emotional and
physical distress , particularly to low-income elderly tenants; and
WHEREAS, because of similar abuses and a similar failure
by State Legislatures and State Courts to adequately address such
abuses, Congress last year adopted a Federal Condominium Act to pro-
tect condominium purchasers from unconscionable recreational
leases;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the House Aging Committee and
its Sub-Committee on Housing & Consumer Interests; the House Bank-
ing , Finance and Urban Affairs Committee and its Sub-Committee on
Housing and Community Development; and the Senate Committees on Ag-
ing and on Banking, Housing & Urban Affairs are hereby requested to
adopt legislation protecting the health, welfare and safety of el-
derly and low-income tenants from condominium conversions , by: (i)
requiring at least three years ' notice prior to conversion of any
dwelling occupied by persons over 62 years old, or with annual gross
incomes less than $15,000; (ii) by requiring 65% acquiescence of
tenants prior to conversion; (iii) by imposing a temporary
moratorium on condominium conversions in communities with 5% or less
vacancy rates in the rental-dwelling market, and; (iv) by imposing
other appropriate safeguards to protect communities from
uncontrolled conversion of rental accommodations to condominium
parcels.
