A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE AN AGREEMENT BETWEEN
METROPOLITAN DADE COUNTY, A POLITICAL SUB-
DIVISION; AND THE CITY OF MIAMI BEACH, A
MUNICIPAL CORPORATION, ALLOWING THE INSTALLA-
TION OF BUS STOP SHELTERS ON COUNTY PROPERTY;
AND PROVIDING THAT COUNTY PERMITS BE OBTAINED
AND MTA APPROVAL BE GRANTED.
WHEREAS, the City of Miami Beach has requested the in-
stallation of bus stop shelters on County property, and
WHEREAS, Metropolitan Dade County agrees that a portion of
its land may be used as a bus stop shelter for the benefit of the
general public; providing that County Permits be obtained and MTA
approval be granted.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk
are hereby authorized to execute an agreement between Metropolitan
Dade County, a political subdivision; and The City of Miami Beach, a
municipal corporation, allowing the installation of bus stop shel-
ters on County property; and providing that County Permits be
obtained and MTA approval be granted.

Dear Mr. Aymonin:
We are in receipt of the agreement and City of Miami Beach Resolution
No. 81-16676 requesting Metro Transit Agency and Public Works Department
approvals to construct six bus shelters along 17th Street and West Avenue.
Both de•artments have reviewed the sites and hereb a• •rove the munici•al
request to construct the bus shelters on County right of way. A copy of
the memorandum from MTA is included with their comments.
As you know, the County currently maintains these roadways; however, since
these roads are functionally classified as City streets, maintenance
responsibility will be automatically transferred to the City on July 1,
1982. s view of the •endin: transfer we feel that a le -r •- _
the County granting approval to construct the proposed bus shelters is
adequate. Until transfer occurs, the City will be responsible for the
maintenance and upkeep of the shelters and hold harmless and indemnify
the County from any claims associated with the shelters.
We are returning the agreement documents, unsigned, for your future use
at other shelter locations on the County road system within the City of
Miami Beach.
We trust the above will serve to expedite the resolution of this matter.

THIS AGREEMENT, made this 3rd day of June , 19 81 ,
by and between METROPOLITAN DADE COUNTY, a political subdivision of
the STATE OF FLORIDA, hereinafter referred to as the "COUNTY" and
CITY OF MIAMI BEACH, a municipal corporation of COUNTY OF DADE,
hereinafter referred to as "CITY" .
WITNESSETH :
WHEREAS , the City has requested the installation of bus
stop shelters on County property described in the drawing (s) ,
attached hereto; and
WHEREAS, the County agrees that a portion of its land may
be used as a bus stop shelter for the benefit of the general public;
providing that County Permits be obtained and MTA approval be
granted.
NOW, THEREFORE, in consideration of the mutual benefits
accruing to the parties hereto and of the premises contained herein,
the County does hereby grant permission to the City to construct and
maintain a bus stop shelter on a portion of the above-described
land, said portion being that area shown on the attached Drawing
which is made a part of this Agreement, on the following terms and
conditions:
1. The term of this Agreement shall be for a period of
nine (9) years commencing on the 3rd day of
June , 1981
2 . The City shall construct on the described area a bus
stop shelter . This shelter and facilities shall be
for the use of the general public with all rights of
ingress and egress in, on and over the County ' s
proprty identified on said Drawing. It is agreed
that said shelter and facilities so constructed shall
remain the property of the City or its contractors.

3 . The City agrees that it will be responsible for the
maintenance and upkeep of the bus stop shelter . The
City also agrees that it will be responsible for the
maintenance and upkeep of the ground area immediately
adjacent to the bus stop shelter .
4 . The City agrees , to the extent of the monetary limi-
tations specified in 768 . 28 (5) F. S. (1979) , to save
harmless and indemnify the County of and from any and
all expenses arising because of any claim which may
hereafter be presented by anyone for injury, damage
or death to persons or injury or damage to property
occurring in or about aforesaid bus stop shelter
occasioned by the construction, use and existence of
said shelter and which is caused by the negligence of
the City or its contractors.
IN WITNESS WHEREOF, the parties hereto have caused this
Agreement to be signed in person or by a person thereunto duly
authorized, the day, month and year first hereinabove written.

This is in response to pmL Znc'nol andum of June 16 , 199 1 Concr ning
a request from the City or Miami Beach to install six bus shelters
on roadways currently maintained by Dade County within the munici-
pality.
The MTA has field investigated the six locations and found all
proposed installation:; :satisfactory.
We would like to suggest , however , that site #49 could he relocated
immediately adjacent to the bus stop sign , about 30 feet south
of the proposed site . This would place it on a grassy area just
clearing the driveway of the Lincoln West Towers garage . Further ,
during the rainy season , passengers may complain that they are
getting wet as they walk from the shelter to the front of the bus.
