A RESOLUTION OF THE MAYOR AND THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE A WORK ORDER WITH METRO
EXPRESS INC., IN THE NOT TO EXCEED AMOUNT OF $500,000; TO
PERFORM NECESSARY IMPROVEMENTS RELATED TO MAINTENANCE OF
TRAFFIC ALONG INDIAN CREEK DRIVE BETWEEN 24TH STREET AND 29TH
STREET, IN ORDER TO ALLEVIATE TRAFFIC CONGESTION AND INCREASE
PEDESTRIAN SAFETY.
WHEREAS, in September 2016, the City of Miami Beach, in partnership with the Florida
Department of Transportation (FDOT), entered into a Department Funded Agreement (DFA) to
implement drainage improvements and raise Indian Creek Drive, from 26th Street to 41st Street;
and
WHEREAS, the agreement with FDOT stipulated a Department participation of 78.7% and
a City participation of 21.3% of the total allowable costs; and
WHEREAS, the project was divided into three phases. Phase 1 and 2, now substantially
complete, included the construction of the major stormwater system along Indian Creek Drive
between 25th Street and 32nd Street; AND
WHEREAS, the bid documents for Phase 3 (ITB No. 2018-054-ZD), which included
roadway reconstruction and drainage improvements north of 32nd Street, were issued on
September 21, 2018; and
WHEREAS, although three bids were received, the lowest bidder was deemed non-
responsive and the next low bid significantly exceeded the City's available budget, and
accordingly, the Phase 3 project was not awarded; and
WHEREAS, since the rejection of Phase 3 bids, staff has been working with the Engineer
of Record and FDOT to value engineer the project, and currently anticipates to re-advertise the
project in May 2019, with a corresponding construction start date of September 2019; and
WHEREAS, the traffic control plan that is currently in place, was initially intended to
adequately service the area during a temporary transition between Phase 2 and Phase 3 of the
contract, for a period of approximately six (6) months only; and
WHEREAS, due to the delays associated with the award and commencement of
construction of Phase 3, the current traffic control plan needs to be revised; and
WHEREAS, the City has developed temporary improvements that will alleviate traffic
congestion and increase pedestrian safety along Indian Creek and Collins Avenue. The
improvements would include:
(1) The installation of a temporary pedestrian signal and crosswalk on the west side of the
Collins Avenue and 26th Street intersection;
(2) Modification of the traffic lanes along Indian Creek Drive, south of 29th Street to create
two continuous southbound lanes;
(3) Overlay of the northbound pavement and removal of the existing traffic barrier along
Collins Avenue between 25th Street and 26th Street, to allow left in and left out movements for
properties on the east side of the road; and
WHEREAS, staff has coordinated with FDOT regarding FDOT's cost share participation
and FDOT has agreed to participate in the aforementioned proportionate share of the estimated
construction cost of the improvements; and
WHEREAS, City staff is currently negotiating the final costs with Metro Express Inc., in the
not exceed amount of $500,000.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission
hereby approve and authorize the City Manager to negotiate and execute a work order with Metro
Express Inc., in the not to exceed amount of$500,000; to perform necessary improvements related
to maintenance of traffic along Indian Creek Drive between 24th Street and 29th Street, in order
to alleviate traffic congestion and increase pedestrian safety.

ANALYSIS
In September 2016, the City of Miami Beach, in partnership with the Florida Department of
Transportation (FOOT), entered into a Department Funded Agreement (DFA) to implement
drainage improvements and raise Indian Creek Drive from 26th Street to 41st Street. The
agreement with FDOT stipulated a Department participation of 78.7% and a City participation of
21.3% of the total allowable costs.
The project was divided into three phases. Phase 1 and 2, now substantially complete, included

2019, with a corresponding construction start date of September 2019.

expected to last approximately six (6) months. However, due to the delay in construction
associated with the unresponsive bid submittals, the current traffic control needs to be revised.
To that end, the City has developed temporary improvements that will alleviate traffic congestion

and increase pedestrian safety along Indian Creek Drive and Collins Avenue. The
improvements include:
1. The installation of a temporary pedestrian signal and crosswalk on the west side of the Collins

CURRENT STATUS
Staff has coordinated with FDOT regarding State participation and FDOT has agreed to
participate in the aforementioned proportionate share of the estimated construction cost of the
improvements. City staff is currently negotiating the final costs with Metro Express Inc., in the
not exceed amount of$500,000.
The City has an existing competitively procured contract with Metro Express Inc., which line item
pricing will be used as the base pricing for the proposed work. This Resolution is being
presented as time is of the essence for the needed improvements.
CONCLUSION
The Administration recommends approving the resolution.
