Ordinance 2019-4257 ORDINANCE NO. 2019-4257 AN.ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING CHAPTER 2 OF THE CODE OF THE CITY OF MIAMI BEACH, ENTITLED "ADMINISTRATION," BY AMENDING ARTICLE III, ENTITLED "AGENCIES, BOARDS AND COMMITTEES," BY AMENDING DIVISION 15 THEREOF, ENTITLED "SISTER CITIES PROGRAM" ("PROGRAM"), BY DELETING PROVISIONS REGARDING THE COORDINATING COUNCIL OF THE PROGRAM AND PROVIDING THAT THE PROGRAM SHALL BE ADMINISTERED BY THE MIAMI BEACH CHAMBER OF COMMERCE AND GOVERNED BY REGULATIONS AS MAY BE ESTABLISHED BY THE CITY COMMISSION BY RESOLUTION; AND, PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. WHEREAS, in the interest of enhancing the management of the City's Sister City Program, the Program should be administered by the Miami Beach Chamber of Commerce. • NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Division 15, of Article III, of Chapter 2 of the Code of the City Miami Beach is hereby amended as follows: Chapter 2 ADMINISTRATION * * * Article III. Agencies, Boards and Committees * * * Division 15. Sister Cities Program Sec. 2-181. Established; purpose; powers. and—clAties omposition administration, supporting department. (a) Established: There is hereby established a Sister Cities Program, whose purposes, - - - • - - - - , -- - - . .e -, •• - • -- - - - -- •- and general governing regulations are as set forth in this section. (b) Purpose. See subsection (c) of this section. The purposes of the Sister Cities Program are as follows: - - - - • - - - - - - - - - • - - -- - •• - (1) Cause the people of the city and the people of foreign cities to acquire a consciousness of each other, to understand each other as individuals, as members of their community, as citizens of their country and as part of the family of nations:i (2) Promote, as a consequence of such knowledge and consciousness, a continuing relationship of mutual concern betweenthe people of the city and the people of its sister cities.-; and (3) Promote art, cultural, educational and business exchanges between the city and its sister cities, (d)(cl - - _ - -- - - -• • -- - -•-e eeee = - • - cities program. It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made part of the Miami Beach City Code. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the.word "ordinance" may bechanged to "section," "article," or other appropriate word. . SECTION 5. FINANCIAL INFORMATION In order to effectuate the City Code amendments proposed in this Ordinance for the Miami Beach Chamber of Commerce to administer the Sister Cities Program in the future, the City and the Chamber of Commerce will need to execute a Memorandum of Understanding (MOU), which is proposed in an R7 agenda companion item. The proposed MOU sets forth the Chamber's responsibilities for its administration of the Program and provides for a management fee to be paid by the City to the Chamber in an initial annual amount of $20,000, with the management fee for subsequent renewal terms to be subject to appropriation and budget approval in the City's annual budget process. The City of Miami Beach has 10 Sister Cities, listed at the end of this memo. Of those 10, only one is active: the City of Fujisawa, Japan. Fujisawa is the Miami Beach's first Sister City, when the relationship was established in 1958. Miami Beach regularly engages with Fujisawa. This engagement includes the exchanges of art work as part of the annual Japanese Spring Festival, with participation by the Botanical Garden; near-annual hosting of official delegations from the other city; and the exchanges of official letters and gifts via mail for events in the other city, such as the annual Fujisawa Marathon. To-date, our engagement has come entirely through the Office of the Mayor and Commission and has been extremely labor intensive. Aides to Commissioners or the Mayor have had to staff all SSC meetings and carry out all the support activity needed to ensure the engagement described above occurred successfully. In the time since Mayor Gelber's election in 2017, the Sister Cities Committee has experienced significant challenges to operating. The challenges include attendance issues with only 1 meeting with a quorum, requiring coordinating the 2018 Fujisawa visit via subcommittee meetings; for example, it was only in late November 2018 that a Chair was elected. Additionally, the Sister Cities movement worldwide is being rapidly replaced by more direct agency-to-agency Memorandums of Understanding, with more specific and measurable goals in the areas of economic collaboration. Given these challenges and evolution of the Sister City concept globally, it is logical to transition administration of the SSC to the Miami Beach Chamber of Commerce. Management by the Chamber would eliminate a challenge from the Sunshine Law and allow communication outside of public meetings. The Chamber also has experience engaging internationally and can provide vision as to how the SSC can be effective. If you have additional questions please do not hesitate to let me know.
