A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH; AUTHORIZING THE
EXECUTION OF AN AGREEMENT BETWEEN THE CITY
OF MIAMI BEACH AND NORMAN A. GILLER AND
ASSOCIATES FOR THE PROTECT KNOWN AS THE 21ST
STREET COMMUNITY CENTER EXPANSION/COLLINS
CANAL-22ND STREET WALKWAY.
WHEREAS, the City of Miami Beach has made and entered into an
agreement with Norman A. Giller and Associates, a Florida Partnership (hereinafter
referred to as the Architect) for Architectural services being provided for the 21st Street
Community Center Project;
WHEREAS, the City intends to construct a new multi-purpose auditorium
facility, a new pedestrian walkway, and site improvements subject to certain total
construction costs, maximum Architect basic services fees, and other terms and conditions
set forth in the agreement between the City and the Architect;
WHEREAS, the 21st Street Community Center project includes a new
structure, site improvements, a landscape pedestrian walkway and seawall repairs
hereinafter designated as the project;
WHEREAS, the City has contracted with the Architect enumerated above
for architectural services in connection with the design and construction of the project, and
for the administration of the construction contract during construction of the project, all as
stipulated and within limits the City has budgeted therefor as provided in said agreement;
and
WHEREAS, the Architect has consented to execute an agreement which
accurately sets forth the mutual covenants, terms and conditions between the parties for
the services the latter shall provide relative to the 21st Street Community Center project;
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City
of Miami Beach, Florida;
That the City Commission approves of and authorizes the City to enter
into an agreement with the firm of Norman A. Giller and Associates services in connection
with the 21st Street Community Center Project.
