A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING
THE MAYOR AND THE CITY CLERK TO EXECUTE AN
OWNER/ARCHITECT AGREEMENT BETWEEN THE CITY
OF MIAMI BEACH AND JAMES STEWART POLSHEK AND
PARTNERS FOR THE REBUILDING OF THE THEATER
OF THE PERFORMING ARTS AND AUTHORIZING THE
CITY MANAGER TO MODIFY THE TERMS OF SAID
AGREEMENT PRIOR TO ITS EXECUTION.
WHEREAS, the City Commission has reviewed the agree-
ment between the City of Miami Beach (hereinafter referred to as
the City) and James Stewart Polshek and Partners (hereinafter
referred to as the Architect) for the rebuilding of the Miami
Beach Theater of the Performing Arts; and
WHEREAS, the City desires to engage the Architect to
render architectural, engineering and professional services to
rebuild, reconstruct, convert and refurnish the Theater of the
Performing Arts upon the terms and conditions of the agreement
between the City and the Architect; and
WHEREAS, the City Manager has recommended execution of
the agreement, and the Office of the City Attorney has approved
it as to form; and
WHEREAS, the City Manager, in consultation with the
City Attorney and Daniel Paul, Esquire, and the Architect may
desire to make certain modifications to the sections of the
agreement dealing with the Architect 's standard of care for the
acoustical, architectural and professional results of this
project, the construction schedule to be formulated for the
project and other non-substantive changes to the agreement prior
to its execution;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COM-
MISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
1. That the Mayor is authorized to execute the
Agreement between the City of Miami Beach and James Stewart
Polshek and Partners for rebuilding the Theater of the
Performing Arts.

2. That the City Manager , in consultation with the
Office
of the CityAttorney and Daniel Paul, Esquire, is
authorized
to modifythe above mentioned sections of the
agreement prior to its execution by the parties.
