Resolution 83-17602 • RESOLUTION NO. 83-17602 A RESOLUTION CALLING FOR A SPECIAL ELECTION TO BE HELD ON MARCH 13, 1984 FOR THE PURPOSE OF SUBMITTING TO THE ELECTORATE OF THE CITY OF MIAMI BEACH AMENDMENTS TO THE CITY'S CHARTER AND RELATED LAWS CONCERNING STAGGERED TERMS FOR CITY COMMISSIONERS , ISSUANCE OF MUNICIPAL BONDS , AND EXPANSION OF THE BOARD OF ADJUSTMENT FROM FIVE TO SEVEN MEMBERS . BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH: SECTION 1 . In accordance with provisions of the Charter of the City of Miami Beach, Florida and the general laws of the State of Florida, a Special Election is hereby called and directed to be held in the City of Miami Beach, Florida, from 7 : 00 o'clock a.m. to 7 : 00 o'clock p.m. on March 13 , 1984 for the purpose of submitting to the electorate the questions as set forth hereinafter . SECTION 2 . The appropriate and proper Dade County election officials shall conduct said election hereby called except for the canvassing of returns of said Special Election, which duty shall be performed by the City Commission. The official returns for each precinct shall be furnished to the City Clerk of the City of Miami Beach as soon as the ballots from all precincts have been tabulated. The official certification of the results of said Special Election shall be made by the City Commission of the City of Miami Beach. SECTION 3 . Said voting precincts in the City of said Special Election shall be as established by the proper and appropriate Dade County Election officials. All electors shall vote at the polling places and the voting precincts in which the OFFICIAL REGISTRATION BOOKS show that the said electors reside. Registration of persons desiring to vote in the said Special -1- OFFICE OF THE CITY ATTORNEY - 1700 CONVENTION CENTER DRIVE -MIAMI BEACH, FLORIDA 33139 • Election shall be in accordance with the general law of the State governing voter registration. SECTION 4 . Copies of the proposed amendments to the City' s Related Laws and to the Miami Beach City Charter shall be made available to the electors at the office of the City Clerk from 9 : 00 o'clock a.m. to 5:00 o'clock p.m. each day, Saturdays, Sundays, and holidays excepted, not later than thirty days prior to the date of said election. SECTION 5 . Not less than thirty days ' notice of said Special Election shall be given by publication in a newspaper of general circulation in Miami Beach, Dade County, Florida. Such publication shall be made at least once each week for four consecutive weeks next preceding said Special Election. SECTION 6 . The notice of election shall be substantially in the following form: THE CITY OF MIAMI BEACH, FLORIDA NOTICE OF SPECIAL ELECTION NOTICE IS HEREBY GIVEN THAT A SPECIAL ELECTION HAS BEEN CALLED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AND WILL BE HELD IN SAID CITY FROM 7 : 00 A.M. UNTIL 7 : 00 P.M. ON THE 13TH DAY OF MARCH, 1984 , AT WHICH TIME THERE SHALL BE SUBMITTED TO THE DULY REGISTERED AND QUALIFIED VOTERS OF THE CITY OF MIAMI BEACH THE FOLLOWING QUESTIONS : QUESTION 1: "SHALL THE CHARTER BE AMENDED PROVIDING THAT WITHIN 90 DAYS AFTER THE MARCH 13 , 1984 SPECIAL ELECTION THREE COMMISSION GROUPS BE SELECTED BY THE CITY COMMISSION TO SERVE TWO- YEAR TERMS COMMENCING IN THE NOVEMBER, 1985 ELECTION, THE THREE REMAINING GROUPS BE SELECTED BY THE COMMISSION TO SERVE FOUR-YEAR TERMS COMMENCING IN THE NOVEMBER, 1985 ELECTION, ALL SUBSEQUENT COMMISSION GROUPS SHALL SERVE FOUR-YEAR TERMS , AND THE MAYOR SHALL SERVE TWO-YEAR TERMS . -2- OFFICE OF THE CITY ATTORNEY - 1700 CONVENTION CENTER DRIVE -MIAMI BEACH, FLORIDA 33139 YES NO QUESTION 2 : "SHALL SECTION 37 (h) OF THE CHARTER OF THE CITY OF MIAMI BEACH REQUIRING ELECTORATE APPROVAL FOR THE ISSUANCE OF A SERIES OF BONDS BY THE CITY IN EXCESS OF $250, 000 . 00, AND BONDS THE PROCEEDS OF WHICH WILL FINANCE ANY PROJECT WHOSE TOTAL COST WILL BE IN EXCESS OF $250 , 000. 00 BE REPEALED?" YES NO QUESTION 3 : "SHALL SECTION 34 OF THE RELATED LAWS , BEING PART OF THE CHARTER OF THE CITY OF MIAMI BEACH, FLORIDA, BE AMENDED TO INCREASE THE EXISTING BOARD OF ADJUSTMENT FROM SEVEN MEMBERS TO NINE MEMBERS, PROVIDING THAT TWO MEMBERS SHALL BE ACTIVE OR RETIRED GENERAL BUSINESSMEN AND FIVE MEMBERS SHALL BE ACTIVE OR RETIRED PROFESSIONALS AND PROVIDING THAT ANY ORDER OR DECISION OF THE BOARD OF ADJUSTMENT SHALL REQUIRE A FIVE/SEVENTHS VOTE. " YES NO SECTION 7 . SECTION 10 . This resolution shall be effective immediately upon its passage.
