A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH APPROVING OF THE RULES AND
REGULATIONS PROMULGATED BY THE CITY OF MIAMI
BEACH HISTORIC PRESERVATION BOARD.
WHEREAS, X26-4 (A) (7) of the City of Miami Beach Historic
Preservation Ordinance, as amended, states that the City Historic
Preservation Board shall make and prescribe such rules and
regulations necessary and appropriate for the administration and
enforcement of the Historic Preservation Ordinance; and
WHEREAS, the aforementioned rules and regulations shall
have the force and effect of local law upon their approval by the
City Commission and the filing of the rules with the City Clerk;
and
WHEREAS, such rules and regulations have been drafted by
the office of the City Attorney, which rules and regulations are
promulgated pursuant to the ordinance and do not conflict with the
Historic Preservation Ordinance or the Constitution and general
laws of the State of Florida; and
WHEREAS, the rules and regulations govern and control
administrative procedures, hearings and actions before the Board;
and
WHEREAS, the Board has held a public hearing on these
rules and has voted in favor of their adoption; and
WHEREAS, the Planning Department and the City Manager
recommend that the City Commission approve these rules in order to
establish an administrative procedure for the Board,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH THAT:
1. The City Commission hereby approves and adopts the
Rules and Regulations governing the procedure of the City of Miami
Beach Historic Preservation Board; and
2. A copy of the Miami Beach Historic Preservation
Board Rules and Regulations shall be maintained by the City Clerk
