RESOLUTION 84-17815 RESOLUTION NO. 84-17815 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE GRANTS OF EASEMENT BETWEEN THE CITY OF MIAMI BEACH AND THE GRANTORS , CHEEZEM DEVELOPMENT CORPORATION, WEST FLAGLER ASSOCIATES LIMITED, BISCAYNE KENNEL CLUB, INC. , INVESTMENT CORPORATION OF SOUTH FLORIDA, AND WJA REALTY LIMITED PARTNERSHIP, FOR A PORTION OF THE NORTHWEST 1/4 OF SECTION 10 , TOWNSHIP 54 SOUTH, RANGE 42 EAST, CITY OF MIAMI BEACH, DADE COUNTY, FLORIDA TO BE UTILIZED AS AN ACCESS ROAD AND UNDERGROUND UTILITY EASEMENT. WHEREAS , the City of Miami Beach has approved the acceptance of two (2) Grants of Easement in the Access Easement Agreement and the Utility Easement Agreement between the City of Miami Beach and the Grantors, Cheezem Development Corporation, West Flagler Associates Limited, Biscayne Kennel Club, Inc. , Investment Corporation of South Florida and WJA Realty Limited Partnership, for the property described as a portion of the N.W. 1/4 of Section 10, Township 54 South, Range 42 East, City of Miami Beach, Dade County, Florida; and WHEREAS, the Access Easement shall be utilized for the purpose of constructing, reconstructing, repairing, operating, and/or maintaining of a public roadway allowing the ingress to and the egress from the park by vehicles of unlimited size and weight, including , without limitation, cement and other trucks and cranes, for general construction and other access purposes. The Access Easement shall terminate on July 31, 1984; provided however , that upon written notice by the City to Grantors and Cheezem, this Access Easement shall be extended for an additional one (1) year period without additional consideration; and WHEREAS , the Utility Easement shall be for the installation, maintenance, repair and replacement of such electric, irrigation, drainage and other utility lines, equipment and fixtures, and exterior lighting and landscaping providing utilities to the park. The utilities shall be installed underground in accordance with good engineering design. This Utility Easement shall be perpetual; and OFFICE OF THE CITY ATTORNEY-1700 CONVENTION CENTER DRIVE-MIAMI BEACH, FLORIDA 33139 WHEREAS , the City of Miami Beach has paid in hand for consideration the sum of Ten Dollars ($10 . 00) and other good and valuable consideration; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the City of Miami Beach formally accepts these two (2) Grants of Easement in the Access Easement Agreement and the Utility Easement Agreement of the above described property.
