RESOLUTION 84-17834 RESOLUTION NO. 84-17834 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND ACCEPTING THE SETTLEMENT OFFER RELATING TO YOUTH CENTER SETTLEMENT IN CITY OF MIAMI BEACH V. FERENDINO/GRAFTON ETC. WHEREAS, in 1981, the City of Miami Beach sued Ferendino/Graf ton and Seldin Construction Company for defects re- lating to the Miami Beach Youth Center ' s ice skating rink and gymnasium floor ; and WHEREAS, in Resolution No. 84-17674 , the City of Miami Beach accepted $125,000. 00 in settlement of its claims against Seldin Construction Company (relating to the ice skating rink) and Western Waterproofing, as subcontractor (relating to the gym- nasium floor) ; and WHEREAS, Seldin Construction Company has assigned its judgment against its subcontractor , the Dublin Company, in the amount of $74 ,782.40 to the City of Miami Beach; and WHEREAS, Travelers Insurance Company has offered to pay the City of Miami Beach seventy-five percent of the $74 ,782. 40 judgment against the Dublin Company and seventy-five percent of the statutory interest which has been accruing since the date of the judgment; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COM- MISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the settlement offer of Travelers Insurance Company as outlined more fully in the attached Commission Memorandum dated September 5 , 1984 , under which the City of Miami Beach would receive $56 ,086.80 from Travelers Insurance Company (seventy-five percent of $74 ,782. 40) plus seventy-five percent of the statutory interest accrued since the date of the judgment is hereby approved and accepted in settlement of City of Miami Beach v.
