A RESOLUTION DECLARING THE ACQUISITION OF
LOTS 1, 2, 10, 11 AND 12, BLOCK 55, AND
LOTS 14, 15 AND 16 , BLOCK 54, ORCHARD
SUBDIVISIONS NUMBERS 2 AND 3, AS RECORDED IN
PLAT BOOK 8 , PAGE 116, PUBLIC RECORDS OF DADE
COUNTY, FLORIDA (NORTH SIDE OF WEST 40TH
STREET BETWEEN ROYAL PALM AND PRAIRIE AVENUES)
TO BE A PUBLIC NECESSITY AND DIRECTING THE
CITY ATTORNEY TO INSTITUTE THE FILING OF
EMINENT DOMAIN PROCEEDINGS, INCLUDING
DECLARATION OF TAKING, TO ACQUIRE SAME.
WHEREAS, in Resolution No. 84-17740, the City Commission
of the City of Miami Beach approved the site selection for the
City of Miami Beach Forty-First Street/Off-Street Parking Project,
which included Lots 1, 2, 10, 11 and 12, Block 55 , and Lots 14 ,
15, and 16, Block 54, Orchard Subdivision Numbers 2 and 3, as
recorded in Plat Book 8, Page 116, Public Records of Dade County,
Florida; and
WHEREAS, in the aforementioned Resolution, the City
Manager and the City Attorney, through their staffs or through
special counsel, were authorized by the City Commission to acquire
said lots by purchase, donation, or through eminent domain
proceedings, including declaration of taking as necessary; and
WHEREAS , institution of the filing of eminent domain
proceedings is now necessary to acquire the above-described
properties; and
WHEREAS, the City Commission finds, determines and
declares that the acquisition of fee simple title to the above-
described properties is a public necessity and is necessary,
practical and in the best interest of the City of Miami Beach; and
WHEREAS, the City Commission finds, determines and
declares that the acquisition of the above-described properties by
institution of eminent domain proceedings is for the public use
and benefit,

NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT:
1. The City Commission finds, determines and declares
that the matters set out in the foregoing recitals are true and
correct, and they are hereby incorporated as a portion of this
Resolution.
2. The City Commission declares that it is necessary to
acquire fee simple title to Lots 1, 2, 10, 11 and 12, Block 55,
and Lots 14, 15 and 16, Block 54, Orchard Subdivision Numbers 2
and 3, as recorded in Plat Book 8, Page 116 Public Records of Dade
County, Florida.
3 . The City Commission authorizes the City Attorney to
acquire the above-described properties through the institution of
eminent domain proceedings, including declaration of taking , as
necessary.

1984 .
