RESOLUTION 85-18005 RESOLUTION NO. 85-18005 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RECOMMENDING THAT THE DADE COUNTY BOARD OF COUNTY COMMISSIONERS NOT ADOPT THE PROPOSED BISCAYNE BAY SHORELINE REVIEW ORDINANCE AND REQUESTING THAT THE COUNTY COMMISSION HOLD COUNTY-WIDE PUBLIC HEARINGS AND WORKSHOPS WITH DEVELOPERS AND AFFECTED MUNICIPALITIES PRIOR TO FINAL READING OF THE ORDINANCE. WHEREAS, Metropolitan Dade County and the City of Miami Beach share proximity to and concern for Biscayne Bay, the largest natural water resource in Dade County; and WHEREAS, Metropolitan Dade County has adopted the Biscayne Bay Management Plan, which seeks to develop a unified, County-wide management plan to maintain and enhance the character and value of Biscayne Bay; and WHEREAS, Metropolitan Dade County staff has prepared an ordinance purportedly to implement development controls for the Shoreline adjacent to Biscayne Bay, including that portion of the shoreline within the corporate limits of the City of Miami Beach; and WHEREAS, certain sections of the proposed ordinance include provisions for public acquisition, maintenance and liability for public walkways on private property; and WHEREAS, Section 9 of the proposed ordinance creates requirements for City staff activity which would create an undue burden on City resources; and WHEREAS, the proposed ordinance excessively infringes on the local authority of the City of Miami Beach to control development activity within its corporate limits; and -1- OFFICE OF THE CITY ATTORNEY-1700 CONVENTION CENTER DRIVE-MIAMI BEACH,FLORIDA 33139 WHEREAS, the proposed ordinance proposes excessive and unrealistic standards for compliance by developers. NOW THEREFORE, BY IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH: that, it recommends that the Dade County Board of County Commissioners not adopt the Biscayne Bay Shoreline Review Ordinance as presently proposed and requests that the County Commission hold County-wide public hearings and workshops with developers and affected municipalities prior to final reading of the ordinance.
