RESOLUTION 85-18015 RESOLUTION NO. 85-18015 A RESOLUTION OF THE CITY COMMISSION OF MIAMI BEACH, FLORIDA, AUTHORIZING THE ABANDONMENT OF A NORTH-SOUTH STREET END KNOWN AS CHEROKEE AVENUE LYING BETWEEN THE PLATS OF BEACH VIEW ADDITION AND LAGORCE GOLF SUBDIVISION, OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA, AUTHORIZING EXECUTION AND DELIVERY OF A QUIT- CLAIM DEED TO SAID ABANDONED REAL PROPERTY TO THE ADJOINING PROPERTY OWNERS, AND PROVIDING FOR THE RESERVATION OF A UTILITY EASEMENT THEREIN. WHEREAS, the Plats of Beach View Addition and La Gorce Golf Subdivision were approved and recorded respectively in Plat Book 16, at Page 10 and Plat Book 14 at Page 13 of the Public Records of Dade County, Florida; and WHEREAS, lying between said plats is a public street end, approximately 60+ feet in width, running north and south, bounded on the east by Lot 1, Block 12, Beach View Addition and bounded on the west by Lot 1, Block 3, La Gorce Golf Subdivision; and WHEREAS, the owners of Lot 1 in Block 12; Beach View Addition petitioned the City Commission of the City of Miami Beach to abandon, vacate, surrender and disclaim any and all right, title, and interest in said public street-end adjoining and immediately west of said lot 1; and WHEREAS, the City of Miami Beach has not at any time constructed, paved, maintained or repaired said street end, except for the installation and maintenance of utilities therein, and the adjoining property owners have landscaped, fenced, built upon and have otherwise treated and used said street end as though it were their own property; and WHEREAS, the abandonment, vacation, disclaimer, and surrender of the subject property is deemed to be in the best interest of the City of Miami Beach and its citizens; and WHEREAS , the Public Works Department of the City of Miami Beach recommends the City retain a full utility easement to -1- OFFICE OF THE CITY ATTORNEY-1700 CONVENTION CENTER DRIVE-MIAMI BEACH,FLORIDA 33139 continue to maintain its Sanitary Sewer and also be available in the future for storm sewers, possibility of relocating the 20" water line on Alton Road into an easement through LaGorce Country Club, and such other utilities as may be appropriate or necessary in the future. NOW, THEREFORE BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City of Miami Beach does hereby surrender , abandon, vacate, and disclaim all of its right, title and interest in and to that portion of the north-south street end, known as Cherokee Avenue, lying between Lot 1, Block 12, Beach View Addition according to the Plat thereof recorded in Plat Book 16 , at Page 10 of the Public Records of Dade County, Florida, and Lot 1, Block 3 , La Gorce Golf Subdivision, according to the Plat thereof, recorded in Plat Book 14, at Page 43 , except insofar as the City reserves in said property a utility easement for the installation, maintenance and repair of its sanitary sewer, future storm sewers, and the possibility of relocating the 20" water line on Alton Road into an easement through LaGorce Country Club, and such other utilities as may be appropriate or necessary in the future, and the Mayor and City Clerk are hereby authorized to execute a Quit Claim Deed to said property to the adjoining property owners as provided by law.
