A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE
EXECUTION OF A SECOND AMENDMENT TO THE AMENDED
AND RESTATED TENNIS AGREEMENT ENTERED INTO BY
AND BETWEEN CAPITAL BANK AND THE CITY OF MIAMI
BEACH.
WHEREAS, the City of Miami Beach and Capital Bank have
previously entered into an Amended and Restated Tennis Agreement
dated August 5 , 1983, as amended May 2 , 1984 ; and
WHEREAS, the City has agreed to allow Capital Bank to
present tennis events for a total of twenty-one (21) days per
calendar year (as opposed to a consecutive twenty-one-day-period
originally provided for) ; and
WHEREAS, the advance notice to the City required of
Capital for presentation of tennis events has been shortened from
six (6) months to not less than sixty (60) days subject to the
availability of the tennis center; and
WHEREAS, the City Administration has recommended the
execution of a Second Amendment to the Restated Agreement
incorporating the above changes and the City Attorney has prepared
and approved such an amendment,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH that the City Commission authorizes the
Mayor and the City Clerk to execute the Second Amendment to the
Amended and Restated Tennis Agreement of August 5, 1983 by and
between the parties.
