A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AND
ACCEPTING THE STIPULATION AND ORDER IN SOUTH
SHORE DEVELOPERS, INC. ET AL. V. CITY OF MIAMI
BEACH, FLORIDA, AND MIAMI BEACH REDEVELOPMENT
AGENCY AND AUTHORIZING THE MAYOR TO SIGN SAID
STIPULATION AND ORDER.
WHEREAS, on September 18 , 1984 , a Final Judgment was
entered in South Shore Developers, Inc. et al. v. City of Miami
Beach, Florida, and Miami Beach Redevelopment Agency, Eleventh
Circuit Court Case No. 82-24526 (19) ; and
WHEREAS, said Final Judgment authorized the Circuit
Court to retain jurisdiction for purposes of enforcing the
judgment; and
WHEREAS, a Stipulation and Order (attached hereto as
Exhibit "A") has been prepared by the litigants in an attempt to
resolve the remaining controversies and claims existing in
connection with the Final Judgment; and
WHEREAS, subject only to the approval of the court and
the completion of the closing contemplated within the Stipulation,
the City of Miami Beach hereby approves the Stipulation and Order
and authorizes the Mayor to sign said Stipulation and Order.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the
Stipulation and Order in South Shore Developers, Inc. et al. v.
City of Miami Beach, Florida, and Miami Beach Redevelopment Agency
is hereby approved and accepted, and the Mayor is authorized to
sign said Stipulation and Order.
