A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA WAIVING OBJECTION
TO ENCROACHMENTS ON THE PUBLIC RIGHT-OF-WAY
FROM PROPERTY AT 1205-1233 LINCOLN ROAD AND
AUTHORIZING THE EXECUTION OF A REVOCABLE
PERMIT BY THE MAYOR AND CITY CLERK.
WHEREAS , the two story building located at the corner of
Lincoln and Alton Roads at 1205-1233 Lincoln Road, Miami Beach
encroaches on the City of Miami Beach right-of-way by
approximately six (6) inches on the south and east sides of the
building; and
WHEREAS, the owners of said building, Lincoln/Alton
Inc. , in connection with the financing of said property, are
required by the lender as a condition subsequent to closing of the
loan, assurances from the City that the encroachment will not be
removed; and
WHEREAS , owners of said building have petitioned the
City of Miami Beach to execute a Revocable Permit between the
owner and the City of Miami Beach, allowing the encroachment to
remain; and
WHEREAS, the allowance of such use of the City right-of-
way will he subject to the restrictions of the attached Revocable
Permit.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Clerk execute the attached Revocable Permit .
