A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH AUTHORIZING THE ADMINISTRATION TO
CONSIDER THE IMPACTS OF THE STATE ACTIVITY WITH
RESPECT TO THE CHEEZEM PROJECT SITE UPON THE TERMS OF
THE PENROD BROTHERS, INC., LEASE AGREEMENT
WHEREAS, at the regular City Commission Meeting of October 2, 1985,
Resolution No. 85-18223 was adopted; and
WHEREAS, Resolution No. 85-18223 authorizes the Mayor and City Clerk to
execute a Lease Agreement between the City of Miami Beach and Penrod Brothers, Inc., for
a Pier Park restaurant facility; and
WHEREAS, as a result of the attempts of the State of Florida to acquire the
Cheezem Project Site under the Save our Coast Program, the City of Miami Beach received
a letter from Penrod Brothers, Inc., dated October 3, 1985, expressing concerns over the
activity of the State of Florida and its impact; and
WHEREAS, Penrod Brothers, Inc., requested a meeting for the purpose of
re-negotiating the proposed Lease Agreement; and
WHEREAS, Representatives of the City of Miami Beach and Penrod Brothers,
Inc., met in order to discuss the issue; and
WHEREAS, Penrod Brothers, Inc., has now requested certain relief from the
terms of their proposed investment in a restaurant facility in the event the State pursues
the acquisition of the Cheezem Project Site, which if not granted will cause
Penrod Brothers, Inc., to reconsider the entire project.
NOW THEREFORE, BE IT DULY RESOLVED THAT THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Administration is hereby authorized to
consider the impact of the State activity with respect to the Cheezem Project Site upon the
terms of the Penrod Brothers, Inc., Lease Agreement.
