RESOLUTION 87-18798 RESOLUTION NO. 87_18798 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, DECLARING ACQUISITION OF CERTAIN PROPERTIES IDENTIFIED AND DESCRIBED AS THE WASHINGTON AVENUE STREET WIDENING PROJECT; LOTS 1, 2, BLOCK 52, OCEAN BEACH ADDITION NO. 3, PLAT BOOK 2, PAGE 81, PUBLIC RECORDS OF DADE COUNTY FLORIDA, AND NORTH PARTS OF LOTS 1, AND 2, AND SOUTH PARTS OF LOTS 1, AND 2, BLOCK 51, OCEAN BEACH ADDITION NO. 3, PLAT BOOK 2, PAGE 81, PUBLIC RECORDS OF DADE COUNTY, FLORIDA, TO BE A PUBLIC NECESSITY; AUTHORIZING THE ACQUISITION OF SAID PROPERTIES BY PURCHASE, DONATION OR THE FILING OF EMINENT DOMAIN PROCEEDINGS AND DECLARATION OF TAKING, AS NECESSARY. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT: WHEREAS, one of the improvements contemplated in the South Pointe area was the widening of Washington Avenue from Biscayne Street to First Street with funds from the $9.8 million dollar bond issue; and WHEREAS, this project would allow for the interconnection of South Pointe with the Washington Avenue revitalization project; and WHEREAS, the right of way in this area is only 60' and widening width acquisition would increase it to 100'; and WHEREAS, the City Commission, at its January 22, 1987, meeting authorized the Administration to proceed with negotiations with the property owners for purchase of the required acquisitions for right-of-way widening from Biscayne Street to First Street on Washington Avenue; and WHEREAS, for reasons more particularly set forth in the attached Commission Memorandum dated March 18, 1987, the City Administration recommends that the City Commission authorize the City Attorney to institute condemnation proceedings on certain properties in the project area in order to acquire the required right-of-way on Washington Avenue from Biscayne Street to First Street; and WHEREAS, the legal descriptions of the specific properties to be acquired are as follows: Lots 1 and 2, Block 52, Ocean Beach Addition No. 3, Plat Book 2, Page 81, Public Records of Dade County, Florida; and North parts Lots 1 and 2, and South parts Lots 1 and 2, Block 51, Ocean Beach Addition No. 3, Plat Book 2, Page 81, Public Records of Dade County, Florida; and WHEREAS, the City Commission finds, determines and declares that it is necessary to acquire fee simple title to such properties for use of the Washington Avenue right-of-way; and WHEREAS, the City Commission, finds, determines and declares that the acquisition of the above-described properties is a public necessity and is necessary, practical and in the best interest in the City of Miami Beach; and WHEREAS, the City Commission finds, determines and declares that the acquisition of the above-described properties by purchase, donation, or eminent domain proceedings is for the public use and benefit. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT: 1. The City Commission finds, determines and declares that matters set out in the foregoing recitals are true and correct and they are hereby incorporated as a portion of this Resolution. 2. The recommendation of the City Manager that the City Attorney institute condemnation proceedings in order to acquire the required right-of-way on Washington Avenue from Biscayne Street to First Street, for the Washington Avenue Street Widening Project, is hereby accepted and approved. 3. The City Commission declares that it is necessary to acquire fee simple title to: Lots 1 and 2, Block 52, Ocean Beach Addition No. 3, Plat Book 2, Page 81, Public Records of Dade County, Florida; and North parts Lots 1 and 2, and South parts Lots 1 and 2, Block 51, Ocean Beach Addition No. 3, Plat Book 2, Page 81, Public Records of Dade County, Florida; and 4. The City Commission finds, determines and declares that the acquisition of the above-described properties by purchase, donation or eminent domain proceedings is for the public use and benefit. 5. The City Commission finds, determines and declares that the acquisition of the above-described properties is a public necessity and is necessary, practical and in the best interest of the City of Miami Beach. 6. The City Commission authorizes the City Manager and the City Attorney, through their staffs or through special counsel engaged for such purposes, to acquire the above-described properties through purchase, donation or through eminent domain proceedings, including the declaration of taking. 87-18798 PASSED and ADOPTED this 18 day of March 1987.
