A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AMENDING RESOLUTION 86-18630 FOR
POLICE CONFISCATION TRUST ACCOUNT FOR FISCAL YEAR
1986/87 SO AS TO IiVCREASE THE APPROPRIATION THEREOF.
BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, that the City Commission of the City of Miami Beach, Florida
hereby adopts the amendment to Resolution 86-18630 of the operating budget for
Police Confiscation Trust Account, a true and correct listing of which is included and
incorporated herein by reference, and the monies therein be and the same are hereby
appropriated as follows:

SUBJECT: POLICE CONFISCATION TRUST ACCOUNT FOR FISCAL. YEAR 1986/1987
The Administration requests an amendment to Resolution 86-18630 to the operating budget
of the Police Confiscation Trust Account to appropriate an additional $100,000.00 to be used
for the purchase of ten (10) undercover vehicles for the SIU Division. The additional
appropriation will increase the Police Confiscation Budget to a total of $625,974.00 for the
fiscal year 1986/1987.
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the City Commission adopt the operating budget for
the Police Confiscation Trust Account and appropriate funding.

EXPENDITURE OF CONFISCATED FUNDS
SUBJECT:
SIU has requested a legal opinion as to the
propriety of expending funds from the Miami Beach
Police Contraband Forfeiture Account for the
purchase of ten (10) vehicles based upon the facts
listed below. Because of the specialized nature of
these vehicles , I believe that the expenditure
would be justifiable , subject to a below mentioned
proviso, under the forfeiture statute .
1 . The vehicles purchased are to be used solely in
protracted and/or complex police undercover
investigations , targeted at vice and narcotic
violators .
2 . The type of vehicle purchased i . e . : over-sized
engine, additional technical equipment
installed , limited quantity to be purchased , is
riot available through the normal
budgeting/purchasing procedures currently
available to the Miami Beach Police Department.
3 . Because these types of vehicles will he better
suited to handle the technical equipment needed
for surveillance , chase and other duties
• ' necessitated by a protracted or complex
investigation , the level of personal safety for
the, officer would be maximized .
4 . The governing body of the municipality shall ,
in open session , review the purchase request
and deem it to be an appropriate expenditure .
The before mentioned proviso is contained in the
Section 932 . 704 (3) (a) restriction that forfeiture
funds "not be a source of revenue to meet normal
' operating needs of the law enforcement agency . " If
equipment purchased with forfeiture funds is used
to operate units involving traditional functions of
the Police Department, and that equipment would
normally be needed to operate such a unit, then the
expenditure would be subject to attack .

I, Ken Glassman, Chief of Police, City of Miami Beach do hereby certify that the
aforementioned request for expenditures from the City of Miami Beach, Police
Confiscation Trust Fund, for the amendment to the operating budget to provide funds
to purchase ten (10) undercover vehicles for the SIU Division complies with the
provisions of Section 932.704, Florida Statutes.
