RESOLUTION 87-18851 RESOLUTION NO. 87-18851 A RESOLUTION OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO CONSIDER WHETHER THE FOLLOWING AMENDMENTS TO THE CITY OF MIAMI BEACH 1980 COMPREHENSIVE PLAN SHOULD BE ADOPTED PURSUANT TO THE COMPREHENSIVE PLANNING AND LAND DEVELOPMENT ACT: (1) AN AMENDMENT PERTAINING TO PROPERTY BETWEEN COLLINS AVENUE AND HARDING COURT FROM 76th TO 79th STREETS BY REMOVING SAID PROPERTY FROM THE "RESIDENTIAL 0-24 UNITS/ACRE" LAND USE CATEGORY AND PLACING SAME IN THE "RESIDENTIAL 25-60 UNITS/ACRE" LAND USE CATEGORY; AND, (2) AMENDING THE DEFINITION OF THE TERM "PUBLIC/INSTITUTIONAL", AS IT APPEARS IN THE CITY'S 1980 COMPREHENSIVE PLAN, TO INCLUDE FACILITIES, THE USE OR OWNERSHIP OF WHICH IS SHARED BETWEEN MUNICIPAL GOVERNMENT AND PRIVATE PARTIES INCLUDING AIR RIGHTS DEVELOPMENTS OVER MUNICIPAL PROPERTY AT THE FOLLOWING LOCATIONS: PROPERTY WITHIN THE CIVIC AND CONVENTION (CCC) ZONING DISTRICT, PARKING LOTS IN THE C-3 (LINCOLN ROAD)ZONING DISTRICT, TWO PARKING LOTS AT 13th STREET AND COLLINS AVENUE, AND CITY OWNED NON- OCEANFRONT PROPERTY IN THE SOUTH POINTE REDEVELOPMENT AREA FOR AIR RIGHTS DEVELOPMENT. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT, WHEREAS, the City Commission held a public hearing on November 19, 1986 to consider transmitting an amendment to the 1980 Miami Beach Comprehensive Plan pertaining to property between Collins Avenue and Harding Court from 76th to 79th Streets by removing said property from the "Residential 0-24 units/acre" land use category and placing same in the "Residential 25-60 units/acre" land use category and voted unanimously to transmit the proposed amendment to the Florida Department of Community Affairs pursuant to the Comprehensive Planning and Land Development Act. WHEREAS, the City Commission held a public hearing on December 17, 1986 to consider transmitting an amendment to the 1980 Miami Beach Comprehensive Plan amending the definition of the term "Public/Institutional", as it appears in the City's Comprehensive Plan, to include facilities, the use or ownership of which is shared between municipal government and private parties including air rights developments over municipal property at the following locations: property within the Civic and Convention (CCC) zoning district, parking lots directly adjacent to the C-3 (Lincoln Road) zoning district, two parking lots at 13th Street and Collins Avenue (northeast and southwest corners), and City-owned non- oceanfront property in the South Pointe Redevelopment Area, and voted unanimously to transmit the proposed amendment to the Florida Department of Community Affairs pursuant to the Comprehensive Planning and Land Development Act. WHEREAS, the Florida Department of Community Affairs reviewed the proposed amendments and transmitted comments which were received on April 16, 1987 which found the amendments to be consistent with statutory requirements. WHEREAS, the City has sixty (60) days from the receipt of comments to hold a public hearing for the purpose of adopting the proposed amendments. NOW, THEREFORE, BE IT DULY RESOLVED THAT THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that a public hearing for consideration of the aforementioned proposals is hereby called to be held before the City Commission in its chambers on the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida, beginning at 2:30 pm on May 20 , 1987, and the City Clerk is hereby authorized and directed to publish appropriate Public Notice of said Public Hearing to be published in a newspaper of general circulation in the City of Miami Beach, at which time and place all interested parties will be heard.
