A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING THE
STIPULATION BETWEEN THE CITY OF MIAMI BEACH
AND STEVE UJSZASZI AND MARGARET UJSZASZI,
OWNERS OF PARCEL NO. 4 IN CITY OF MIAMI BEACH
V. CARCASSES, ET AL. , CONCERNING PAYMENT OF
$400, 000 . 00 AS PARTIAL SETTLEMENT OF THIS
LITIGATION FOR THE TAKING OF LOTS 2 AND 3,
BLOCK 52 , OCEAN BEACH ADDITION NO. 3, PLAT
BOOK 2 , PAGE 81 , PUBLIC RECORDS OF DADE
COUNTY , FLORIDA , AND AUTHORIZING AND
APPROVING THE PAYMENT OF $10 , 000 . 00 FOR
ATTORNEYS ' FEES REGARDING SAID PROPERTIES,
AND FURTHER AUTHORIZING THE APPROPRIATION OF
THESE FUNDS FROM THE WIDENING OF WASHINGTON
AVENUE BOND FUND 357 INTO WORK ORDER 2947 .
WHEREAS, on May 12 , 1987 , the City of Miami Beach, Florida ,
instituted an eminent domain action styled City of Miami Beach v.
Carcasses , et al . , Case No . 87- 20615 , for the purpose of
acquiring four parcels of property in Miami Beach for the purpose
of widening Washington Avenue; and
WHEREAS , Parcel No . 4 of the four above-referenced
properties is owned by Steven and Margaret Ujszaszi and is
legally described as follows :
Lot 2, Block 52, OCEAN BEACH ADDITION NO. 3 ,
Plat Book 2 , Page 81 , Public Records of Dade
County, Florida;
and
WHEREAS, the property adjacent to parcel No. 4 being legally
described as:
Lot 3 , Block 52, OCEAN BEACH ADDITION NO. 3 ,
Plat Book 2 , Page 81 , Public Records of Dade
County, Florida
is also owned by Steven and Margaret Ujszaszi ; and
WHEREAS , in City of Miami Beach Resolution No. 87-18850,
acquisition of said Lot 3 was declared necessary for the widening
of Washington Avenue; and
WHEREAS , as is explained more fully in the attached
Stipulation of July 2, 1987 , the City Attorney has negotiated the
purchase price of $400, 000 . 00, plus reasonable attorneys ' fees in
the amount of $10, 000 . 00 for both of the aforementioned lots in
partial settlement of City of Miami Beach v. Carcasses, et al .
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF

THE CITY OF MIAMI BEACH, FLORIDA that :
1 ) the City Commission finds, determines, and declares that
the matters set out in the foregoing recitals are true and
correct , and they are hereby incorporated as part of this
Resolution; and
2 ) the Stipulation dated July 2 , 1987 between the City of
Miami Beach and Steven and Margaret Ujszaszi concerning payment of
$400 , 000 . 00 for the taking of
Lots 2 and 3 , Block 52, OCEAN BEACH ADDITION
NO. 3 , Plat Book 2, Page 81 , of the Public
Records of Dade County, Florida
is hereby accepted and approved; and
3 ) the recommendation of the City Attorney regarding the
reasonableness of $10 , 000 . 00 in attorneys ' fees for the above
described properties is hereby accepted and approved; and
4) the City Commission thus authorizes the appropriation of
$410 , 000 . 00 for the above-described properties in partial
settlement of City of Miami Beach v . Carcasses , et al . , and
further authorizes that the appropriation of said monies be made
into Work Order 2947 from the widening of Washington Avenue Bond
Fund 357 .
PASSED AND ADOPTED this 15th day of July , 1987 .
