RESOLUTION 87-18932 RESOLUTION NO: 87—18932 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RECOGNIZING THE NEEDS OF RESIDENTS LIVING IN THE AREA OF LOTS 2 AND 3, BLOCK 52, OCEAN BEACH ADDITION 113, STREET ADDRESSES: 710 AND 714 FIRST STREET, MIAMI BEACH, PROVIDING FOR THEIR POSSIBLE COMPENSATION FOR RELOCATION; PROVIDING FOR THE USE OF FUNDS FROM THE 9.8 MILLION DOLLAR SOUTH POINTE INFRASTRUCTURE BOND ISSUE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: WHEREAS, in Resolution 87-18914, the City Commission of the City of Miami Beach approved the settlement agreement finalizing the acquisition of Lots and 3, Block 52, Ocean Beach Addition #3, street addresses: 710 and 714 First Street, in order to widen Washington Avenue from Biscayne Street to First Street; and WHEREAS, it is the intention of the City to compensate fully all those persons entitled to compensation; and WHEREAS, at this phase of the project it is necessary to displace individuals from the property located at 710 First Street (Lot 2); and WHEREAS, when title is obtained for Lot 3, Block 52, Ocean Beach Addition #3, street address: 714 First Street, the same benefits should be applicable; and WHEREAS, the funding to compensate said residents should be appropriated from the 9.8 million dollar South Pointe Infrastructure Bond issue: NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that: 1. All of the above recitals are true and correct; 2. The City Commission hereby directs the City Manager to issue benefits to those residents determined to be eligible in the following manner: A. The tenants shall vacate the property by July 31, 1987, and be current in their rent at the time of their displacement. Eligible tenants will receive compensation @ $225.00, to mitigate the adverse effect of the displacement. 3. Funds in the amount of $6,300.00 will be appropriated from the 9.8 million dollar South Pointe Infrastructure Bond issue to be placed in Work Order #2947 (Washington Avenue Improvements/HN-426). Par ' s 1 APilrk City Manager er & SUBJECT: A RESOLUTI tl N RECOGNIZING THE NEEDS OF THE RESIDENTS LIVING ON LOTS 2 AND 3, BLOCK 52, OCEAN BEACH ADDITION #3, PLAT BOOK 2, PAGE 81, PUBLIC RECORDS OF DADE COUNTY, FLORIDA: STREET ADDRESSES, 710 AND 714 FIRST STREET: PROVIDING FOR THEIR POSSIBLE COMPENSATION FOR RELOCATION; PROVIDING FOR THE USE OF FUNDS FROM THE 9.8 MILLION DOLLAR SOUTH POINTE INFRASTRUCTURE BOND ISSUE (HN-426) TO BE PLACED IN WORK ORDER #2947 In Resolution 87-18914, adopted on July 15, 1987, the City Commision of the City of Miami Beach authorized a settlement agreement finalizing the acquisition of Lots 2 and 3, Block 52, Ocean Beach Addition /13, street addresses: 710 and 714 First Street, as part of the Washington Avenue street-widening project. This phase of the project . necessitates the displacement of tenants from the apartment building located at 710 First Street only (Lot 2). There are estimated to be twenty-eight (28) individuals that will be in need of some relocation assistance due to their involuntary displacement. The City has no Relocation Policy for acquisition-related activities, and, therefore, this action does not come under the Community Development Block Grant Program. In the past, the City Commission has provided for relocation assistance on specific projects, as needed, including other phases of this same project. The City desires to have all property vacated on, or before, July 31, 1987. Tenants could be compensated with a one-time fixed payment @ $225.00, to mitigate the adverse effect of the displacement. All tenants who are listed on the hotel's current rent rolls would be eligible for a benefit, providing they are current in their rental payments. All listed tenants will be interviewed by Community Development Division staff of the Economic and Community Development Department in order to determine eligibility. Relocation payments will be processed against Work Order /12947. Therefore, it is necessary for the City to adopt a Resolution which establishes the relocation benefits proposed, as well as authorizing an appropriation in the amount of $6,300.00 to be allocated from the $9.8 million South Pointe Infrastructure Bond issue (HN-426) and placed in Work Order #2947. Furthermore, the Community Development Division staff will refer tenants to other comparable rental units throughout the City in an effort to make the relocation process as smooth as possible for those persons affected. ADMINISTRATION RECOMMENDATION The Administration recommends that the accompanying Resolution be adopted.
