A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE A FIRST AMENDMENT TO
THE CONCESSION AGREEMENT BETWEEN THE CITY OF
MIAMI BEACH AND PENROD BROTHERS, INC. TO
EXPAND THE SERVICES PROVIDED AT COLLINS PARK
TO INCLUDE BEACH EQUIPMENT.
WHEREAS, the CITY OF MIAMI BEACH ( "City" ) on June 17, 1983
entered into a Concession Agreement ( "Concession Agreement" ) with
ERNEST ENTERPRISES , INC . for concession privileges at South
Pointe Park , Oceanfront Park , Collins Park, 36th Street Open
Space and 65th Street Park; and
WHEREAS , the Concession Agreement was assigned to VEN-DOG
CATERING , INC . pursuant to Resolution No. 84-17755 and was
assigned to PENROD BROTHERS, INC. ( "Concessionaire" ) on November
20 , 1986 pursuant to Resolution No. 86-18678; and
WHEREAS , City and Concessionaire wish to amend the
Concession Agreement to expand the services provided at Collins
Park to include beach equipment rentals; and
WHEREAS , an appropriate Amendment to the Concession
Agreement has been negotiated, the City Manager has recommended
its execution and the City Attorney has approved it as to form.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH that the Mayor and the City Clerk a r e
hereby authorized to execute the First Amendment to the
Concession Agreement between the CITY OF MIAMI BEACH and PENROD
BROTHERS, INC. to expand the services provided at Collins Park to
include beach equipment rentals .
PASSED AND ADOPTED this 29th day of July, 1987 .
