RESOLUTION 87-19042 RESOLUTION NO. 87-19042 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, GRANTING A REVOCABLE PERMIT TO BENO AND EVA ROSENBERG FOR THE PURPOSE OF PROVIDING VEHICULAR INGRESS AND EGRESS THROUGH A MUNICIPAL PARKING LOT KNOWN AS PA-38 . WHEREAS, Beno and Eva Rosenberg (OWNERS) are the owners of the property known as 6930-6936 Collins Avenue and described as: Lot 11, Block D of the Corrected Plat of ATLANTIC HEIGHTS, recorded in Plat Book 9 , Page 14 , of the Public Records of Dade County, Florida; and, WHEREAS, the owners desire to construct a new building for commercial purposes on the described property; and, WHEREAS, said construction required the issuance of a variance and/or variances from the Zoning Board of Adjustment; and, WHEREAS, the Zoning Board of Adjustment granted said variances conditioned upon the owners obtaining access to the rear of said property through the municipal parking lot known as PA-38, in order to provide vehicular ingress and egress from and to the said property; and, WHEREAS, the City finds that it is in the best interest of the City to provide the right of ingress and egress to the owners conditioned upon the owners complying with the terms and conditions contained herein; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the owners Beno and Eva Rosenberg shall and are hereby granted a revocable permit to Owners, of the property known as 6930-6936 Collins Avenue,to allow Owners, Occupants and invitees of Owners or Occupants to enter into, in and across PA-38 upon the following terms and conditions: 1. That the owner at its sole cost and expense improve and reconfigure the parking lot, in accordance with the plans submitted by Post, Buckley, Schuh and Jernigan, Inc. , Traffic 1 Engineers and approved by the City's Director of Public Services or his authorized designee. 2 . That the City in its sole discretion may revoke the permit by giving thirty days prior written notice for any reason and without recourse to the property owner. 3 . In the event the City should determine to improve the lot either by changing its configuration or by construction of any kind on the property; the City may request the owner to pay a reasonable fee for the cost of such re-alignment or other construction caused by the issuance of the permit for ingress and egress. 4 . The owners understand and stipulate and agree that the issuance of this permit is not the conveyance of real property or any right or interest herein. 5. That all construction work required by this permit be accomplished at no cost or expense to the City. 6. That the City Manager is hereby authorized to issue the permit upon acceptance of the terms and conditions contained herein by the Owners. PASSED AND ADOPTED THIS 21st day of October , 1987 .
