RESOLUTION 87-19119 RESOLUTION NO. 87-19119 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE ACCEPTANCE OF A JOINT PARTICIPATION AGREEMENT BETWEEN THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION AND THE CITY OF MIAMI BEACH IN ORDER TO UNDERTAKE A PUBLIC TRANSPORTATION IMPROVEMENT PROJECT TO DEVELOP A PROJECT DEFINITION AND ALIGNMENT AND CAPITAL COST ESTIMATE FOR A MINIMAL LIGHT RAIL PROJECT OR OTHER FEASIBLE TECHNOLOGY FOR A MIAMI BEACH TRANSIT FEASIBILITY STUDY (INCLUDING CONTRACTUAL INDEMNITY) AND REPEALING RESOLUTION NO. 87-19076. WHEREAS, the City of Miami Beach approved a Joint Participation Agreement between the City of Miami Beach and the Florida Department of Transportation for a feasibility study for a Light Rail Transit System; and WHEREAS, Resolution No. 87-19076 passed and adopted on November 18, 1987 by the City Commission of the City of Miami Beach, Florida approved a Joint Participation Agreement in which an indemnity clause had been deleted by the City; and WHEREAS, the State of Florida Department of Transportation has requested that said agreement include the previously deleted contractual indemnity clause in favor of the State of Florida; and WHEREAS, the City of Miami Beach wishes to approve the Joint Participation Agreement with the contractual indemnity clause included, and to repeal Resolution No. 87-19076. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Commission hereby repeals Resolution No. 87-19076, accepts the Joint Participation Agreement with the contractual indemnity clause included and authorizes the Mayor of the City of Miami Beach to execute the attached agreement on behalf of the City of Miami Beach.
