A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A FIRST AMENDMENT TO A CONCESSION AGREEMENT
AS ASSIGNED TO PENROD BROTHERS, INC., FOR THE
OPERATION OF A CONCESSION ON THE BEACH AT SOUTH
BEACH PARK, OCEANFRONT PARK, COLLINS PARK, 36TH
STREET OPEN-SPACE,AND 65TH STREET PARK.
WHEREAS, pursuant to City Commission Resolution No. 83-17356, the City
entered into a Concession Agreement dated June 17, 1983, with Ernest Enterprises, Inc., for
the exclusive privilege of operating beachfront concessions at the following locations:
Area A, South Beach Park; Area B, Oceanfront Park; Area D, Collins Park; Area E, 36th
Street Open-Space Park; and Area H, 65th Street Park; and
WHEREAS, pursuant to City Commission Resolution No. 84-17755, dated
June 5, 1984, the City consented to the assignment of the above-described concession rights
from Ernest Enterprises, Inc., to Ven-Dog Catering, Inc.; and
WHEREAS, pursuant to City Commission Resolution No. 86-18678 dated
November 19, 1986, the City consented to the assignment of the above-described concession
rights from Ven-Dog Catering, Inc., to Penrod Brothers, Inc.; and
WHEREAS, the Concessionaire has not been conducting concession operations at
Area E, 36th Street Open-space and Area H, 65th Street Park and has requested the City
remove the foregoing two areas from the scope of its responsibilities.
NOW THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that:
The Mayor and City Clerk are hereby authorized to execute a First Amendment
to the Concession Agreement with Penrod Brothers, Inc., as assigned from Ven-Dog
Catering, Inc., to remove Area E, 36th Street Open-Space Park and Area H, 65th Street
Park from the scope of the Concession Agreement.
